Mr. L.B. Cockrill, as administrator for Celia Banks, has filed suit in the Circuit Court against the Chesapeake & Ohio Railway Company and Edward Owens and G.H. Sanders, engineer and fireman, for $25,000 for the death of Mrs. Banks. Mrs. Banks was crushed under an engine at the Main Street crossing of the Chesapeake & Ohio Road, in the city, last April. She was badly maimed, and instituted suits against the same parties for damages. The trial of the case was begun at the December term of court here, but before the trial was completed Mrs. Banks died at her home in Breathitt County. Mr. Cockrill was later appointed administrator for her, and brings the new suit in that capacity.

D. S. Gay  Loses His Case.

The first case called for trial in the Circuit Court today was D. S Gay vs the Chesapeake and Ohio Railroad Company in which Mr. Gay is suing to recover some money that he lost on some goods that were destroyed in the fire that destroyed the depot some two years ago. After the hearing of the testimony for the plaintiff the defendant made a motion for preemptory instructions. The judge granted the motion and took the case from the jury.
