Nicholas Berkhard to John Kelley

At the request of JOHN KELLEY the following Deed was recorded January 7, 1853.

This Indenture made and entered into this twenty eighth day of fifty two, between NICHOLAS BERKHARD and Elisabeth his wife, of Allegany County and of the State of Maryland of the one part, and JOHN KELLEY of the County and State aforesaid of the other part, Witnesseth, that the said NICHOLAS BERKHARD and ELISABETH, his wife, for and in consideration of the sum of fifty dollars current money, to them the said NICHOLAS BERKHARD in hand paid by the said JOHN KELLEY at or before the sealing and delivery of these presents, the receipt whereof the NICHOLAS BERKHARD and Elisabeth, his wife, do hereby acknowledge and thereof do release, acquit and discharge the said JOHN KELLEY, his heirs, executors, administrators and assigns, by these presents, they the said NICHOLAS BERKARD and ELISABETH, his wife, have granted, bargained and sold and by these presents do grant, bargain and sell unto the said JOHN KELLEY, his heirs and assigns forever, all that lot, piece or parcel of land lying and being in Allegany County State of Maryland, and being all that part of a tract of land called "Bear Camp" and conveyed by FRANCIS DEAN & MARY, his wife, to THOMAS KEENAN by deed bearing date the 9th day of January 1841, and subsequently conveyed by said THOMAS KEENAN & ELIZABETH, his wife, to said NICHOLAS BERKARD, by deed bering date the 18th day of November 1844 both of which said deeds were duly recorded in the Clerks Office of Allegany County which said Lot or parcel of land his South of a County road leading from JONATHAN ARNOLD's mill, passing the Catholic Church, to the National Road: Beginning for said lot or parcel of land at an oak sapling on the South side on said road at the end of the thirty seventh line of the said ARNOLD's land where it intersects, said road about sixty feet of the point where the BRUEHBURGroad diverges from the said County road, and running thence with the said county road until it intersects the Western line of said tract of land called "Bear Camp" to the place of beginning so as to include said tract of land called "Bear Camp" lying South of said county road Together with all and singular the improvements, advantages, profits and appurtenances thereunto belonging or on any wise appurtaining To Have and To Hold unto him the said JOHN KELLEY, his heirs and assigns forever, and also all the estate, right, title, use, ___ property, claim and demand whatsoever of them the said NICHOLAS BERKARD and ELISABETH his wife, of, on and to the aforesaid lot and premises hereby bargained and sold and to every part and parcel thereof, to the only proper use and benefit of him the said JOHN KELLEY and of his heirs and assigned forever, and to and for no other use, intent or purpose whatsoever And the said NICHOLAS BERKARD and ELISABETH, his wife, for themselves and their heirs, do hereby convenant, grant, promise and agree to and with the said JOHN KELLEY, his heirs and assigns that they the said NICHOLAS BERKARD and ELISABETH his wife, and their heirs, the said lot or parcel of land and premises hereby bargained, granted and sold and every part and parcel thereof with the appurtenances thereunto belonging to him the said JOHN KELLEY his heirs and assigns, against them the said NICHOLAS BERKARD and ELISABETH their heirs and against all and every person or persons whatsoever claiming by, from, or under them shall and will forever defend. In witness whereof the said NICHOLAS BERKHARD & ELISABETH his wife, have hereunto subscribed their names and affixed their seals the day and year above written.

Be it remembered that on this twenty eighth day of October in the year of our Lord one thousand eight hundred and fifty two, personally appeared NICHOLAS BERKARD and ELIZABETH, his wife, party grantors in the above deed or instrument of writing named, before us the subscribers, two Justices of the Peace legally qualified in and for Allegany County State of Maryland, and acknowledged the above deed or instrument of writing to be their act and deed and the land and premises therein mentioned & hereby bargained and sold to be the right and estate of the above named JOHN KELLEY, party grantee, his heirs, and assigns forever, according to the purport, true intent and meaning of the said deed or instrument of writing, and the acts of assembly in such case made and provided And the said ELIZABETH BERKARD, wife of the said NICHOLAS BERKARD, did sign and seal the said instrument of writing before us Justices aforesaid, out of the presence and hearing of her said husband "whether she doth execute and acknowledge the same voluntarily and freely and without being induced to do so by fear or threats of or ill usage by her said husband or fear of his displeasure" declares and acknowledge that she doth execute & acknowledge the same voluntarily and freely and without being induced to do so by fear or threats of or ill usage by her said husband or by fear of his displeasure. We further certify that the said parties so acknowledging are personally known to us to be the party grantors in the above deed or instrument of writing named.

NORMAN BRUCE for WILLIAM KELLEY to JOHN NELSON

This Indenture made this nineteenth day of November in the year of our Lord one thousand eight hundred and forty five between NORMAN BRUCE late Collector of Allegany in the State of Maryland of the one part and JOHN NELSON of the County and State aforesaid of the other, Witnesseth whereas in virtue of an Act of the General Assembly of Maryland entitled an "Act for the more affectual collection of Taxes in Allegany County" passed December Session 1840, Chapter 234 the several tracts parcels and Lots of Land hereinafter mentioned all lying and being in Allegany County aforesaid that is to say in Lots Number thirteen hundred and forty eight and thirty one hundred and thirty two, became chargeable as the property of WILLIAM KELLEY for the payment of the sum of four Dollars and thirty five cents, current money for the County taxes and so forth of said County "Part three tracts of Land belonging to R. LOGSDON's Heirs" became chargeable as the property of CHARLES HOWELL & Company for the payment of the sum of Six dollars and Sixty six cents current money for the county Taxes and so forth of Said County. And the collector of the County aforesaid not finding any personal property in said County liable for or chargeable with payment of the taxes and so forth respectively due on said several tracts, parcels or Lots of Land, the Said Collector did afterwards return to the Commissioners of said Allegany at their annual Meeting in the Month of February that is to say at the meeting which was held for the purpose by the said Commissions on the first Monday of February in the year Eighteen hundred and forty four a list or Statement of the Said Several tracts or Lots of Land and the amount of the Tax thereon respectively due together with names of the owners or persons aforesaid chargeable with payment of the Taxes, Whereupon the said Commissioners caused an advertisement embracing the contents of the list or statement so returned as aforesaid, with the addition thereto of the number of acres supposed to be contained in each tract, parcel or Lot or Land to be inserted once a week for four successive weeks previous to the first day of June in the year Eighteen hundred and forty four in the "Alleganian" and in "The Cumberland Civilian" two newspapers published in the Town of Cumberland "The Baltimore Patriot" a newspaper of the City of Baltimore in the State of Maryland and in "The National Intelligencer" a newspaper published in the City of Washington in the District of Columbia, announcing that ___ the Taxes together with the costs of advertising respectively due on said lands shall be paid to the Collector or his agent CHARLES RARQUHARDON in the City of Baltimore on or before the first day of June next ensuing, the said lands or such parts thereof as the Collector may adjudge sufficient for the payment of the taxes and costs due thereon, will be sold at public auction to the highest bidder for the payment of the same, and whereas the said sums of current money doe on the said lands for the County taxes aforesaid not being paid on or before the said first day of June as made to appear from the Statement or account submitted by the said Collector to the said County Commissioner at the first meeting after the said first day of June (which was held for the purpose on the second Monday of the said month of June) the said commissioners did thereupon order and direct the said NORMAN BRUCE Collector as aforesaid after at least twenty days previous notice, to be given by advertisements expressing the name of the said tracts or Lots the number of acres supposed to be contained in each, the names of the aforesaid persons as the owners thereof and the amount of the taxes and all costs due from such owners, with the time and place of Sale to be inserted in one or more newspapers published in the Town of Cumberland and also set up at some public place in each Election district in Said County to sell the said tracts or Lots of Land to the highest bidder at public auction for the payment of the Taxes and costs due from the aforesaid owners, and the same when sold to transfer by deed of bargain and sale to the purchasers thereof and whereas in virtue of the authority aforesaid so as aforesaid given by the said County Commissioners, the said NORMAN BRUCE Collector as aforesaid after having given twenty days previous notice by advertisement made out in the manner as above directed by the said County Commissioners and inserted in "the Alleganian" and the "Cumberland Civilian" two newspapers published in the Town of Cumberland, and set at one of the most public places in each Election District in the County aforesaid, did on Thursday the twenty second day of August in the year Eighteen hundred and forty four at the Tavern of WILLIAM P. SEARIGHT in the Town of Cumberland expose to public sale to the highest bidder the said tracts, parcels and Lots of Land at which said Sale the hereinbefore named JOHN NELSON became the highest bidder and purchaser of the said tracts & Lots of land as follows that is to say Lots number Thirteen hundred and forty eight (1848) containing fifty acres of Land more or less, Lot number Thirteen hundred and thirty two (3132) containing fifty acres of land more or less - Also "Past three tracts of Land belonging to R. LOGSDON's Heirs" containing fifty and one half acres of land more or less for the following prices that is to say Lots Number Thirteen hundred & forty eight and Thirty one hundred and thirty two at and for the price & sum of four Dollars, and "Part three tracts of Land belonging to R. LOGDSON's Heirs at and for the sum & price of Nine dollars and fifty cents current money which said sums of money the said JOHN NELSON hath since paid and is now desirous of obtaining a title said tracts parcels and Lots of Land in consequence thereof Now therefore this Indenture witnesseth that for and in consideration of the premises and of the sum of one dollar current money to the said NORMAN BRUCE late Collector as aforesaid in hand paid on or before the Sealing and delivery of these presents, the receipt whereof is hereby acknowledged, the Said NORMAN BRUCE late Collector as aforesaid hath here by granted, bargained and sold and by these presents doth grant bargain and sell unto him the said JOHN NELSON his heirs and assigns the said tracts parcels and lots of Land above mentioned that is to say Lots Numbers thirteen hundred and forty eight and thirty one hundred and thirty two and the tract called Part of three tracts of Land belonging to R. LOGSDON's Heirs, with the appurtenances thereto belonging To have and to hold the said tracts on parcels & Lots of Land unto the said JOHN NELSON his heirs and assigns forever, with all the appurtenances to the only proper use and behoof of him the said JOHN NELSON his heirs and assigns forever. PATRICK HAMMILL to JOHN EVERITT (land of DAVID KELLY)

At the request of JOHN EVERITT the following Deed was recorded Oct 12, 1843.

This Indenture made this fourtheenth day of Sept in the year of our Lord one thousand eight hundred and forty three, between PATRICK HAMMILL late Collector of Allegany county in the State of Maryland of the one part and JOHN EVERETT of the county and state aforesaid of the other part. Witnesseth whereas in virtue of an act of General Assembly of Maryland "entitled An Act for the more effecual collection of Taxes in Allegany County" passed December Session 1841 Chapter 234 the Tract or parcel of Land hereinafter mentioned lying and being in the County aforesaid that is to say "Part Elder Spring" became chargeable as the property of DAVID KELLY for the payment of the sum of five dollars and forty cents current money for the county Taxes due of the said County and the collector of the County aforesaid not finding any personal property in the said county6 liable for or chargeable with the payment of the Taxes and respectfully due on the said Tract or parcels of land, the said Collector did afterwards return to the Commissions for Said Allegany County at their annual meeting in the month of February that is to say at the meeting which was held for the purpose by the said County Commissions in the first Monday in February in the year eighteen hundred and forty three a list or Statement of the said land Several Tracts, lots and parcels aforesaid and the amount of the Tax therein respectively due together with the ___ of the pound aforesaid respectively chargeable with the payment of the Taxes whereupon the said Commissions caused an advertisement embrasing the contents of the list or statement So returned as aforesaid with the addition ___ of the number of acres supposed to be contained in each of said Tract and lots of land to be presented once a week for four successive weeks previous to the first day of June in the year eighteen hundred and forty three in the "Alleganian" and "The Cumberland Civilian" two newspapers published in the Town of Cumberland the "Baltimore American" a newspaper published in the City of Baltimore in the said State and the "National Intelligencer" newspaper published in the City of Washington in the District of Columbia ___ that unless the County Taxes together with the cost of advertising respectively __ said lands should be paid to the collector or to his agent CHARLES FERGUSON in the City of Baltimore on or before the said first day of June (being the first day of June next ensuing) the said lands so charged as aforesaid or such parts or parcels thereof as the said Collectors might adjudge Sufficient for the payment of the same. And whereas the said several sums of current money respectively due on the said lands for the County taxes aforesaid not being paid on or before the said First of June as made to appear from the Statement or account submitted by the said collector to the said County Commissions at their first meeting after the said first day of June (which was held for that ___ on the Second Monday of the Said Month of June the said Commissioners did thereon order and direct the said PATRICK HEMMELL Collector ___ after at least twenty days previous notice to be given by advertisements expressing the names of the said Tracts and the numbers of the said lots of land the number of acres supposed to be contained in each Tract and Lot of Land the name of the aforesaid persons as the owners thereof and the amount of the Taxes and all costs ___ due from Tract owners with the time and place at sale to be inserted in one or more newspapers published in the Town of Cumberland and also set - at some public place in each Election District in said County to sell the said several Tracts and lots of land to the highest bidder at public auction for the payment of the Taxes and costs respectively due from the aforesaid owners and the same when sold to transfer by deed of bargain and sale to the purchasers thereof And whereas in Virtue of the authority aforesaid so as ___ given by the said County Commissions that said PATRICK HAMMILL Collector as aforesaid after having given twenty days previous notice by advertisements made out in the manner as above directed by the said County Commissions and inserted in "The Alleganian" and "The Cumberland Civilian" two newspapers as aforesaid in the Town of Cumberland and also set up at one of the most public places in each election district in the county aforesaid did on Monday the twenty first day of August in the year eighteen hundred and forty three at the Tavern of JOHN BLACK in the Town of Cumberland ___ to public sale to the highest bidd or the said several Tracts Lots and parcels of land; at which said Sale the herein bidder and purchaser of the said Land as follows that is to say, at the Tract called "Part Elder Spring" containing two hundred acres at and for the price or sum of eight dollars and twenty three cents which said sum of money the said JOHN EVERETT hath since paid and is now desirous of obtaining a title to the said Tract or parcel of Land in consequence thereof. Now This Indenture Witnesseth that for and in consideration of the ___ and of the sum of ten dollars current money of the United States to the said PATRICK HAMMILL Collector aforesaid in hand paid on or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged the said PATRICK HAMMILL Collector as aforesaid hath granted bargained and sold and by these presents doth grant bargain and sell unto him the said JOHN EVERETT his heirs and assigns the said tract or parcel of land above mentioned that is to say "Part Elder Spring" with the appurtenances thereto belonging, To have and to Hold the said Tract or parcel of Land with all appurtenances unto the said JOHN EVERETT his heirs and assigns forever to the only proper use and behold of him the said JOHN EVERETT his heirs and assigns forever. In Witness whereof the said PATRICK HAMMILL Collector as aforesaid hath hereunto set this hand and affixed his seal the day and year first herein before written.

Patrick Kelly & Catherine his wife to Christopher Kelly

At the Request of Christopher Kelly this deed was Recorded September 8th 1855.

1855 September 8th Received one dollar in Liew of the State of Maryland stamp tax on the following at the time of offering of the same for Record.

This Indenture made this twenty nineth day of August in the year eighteen hundred and fifty five between PATRICK KELLY of Allegany County in the State of Maryland and CATHARINE KELLY his wife of the one part and CHRISTOPHER KELLY of said County and state of the other part whereas the said PATRICK KELLY is a son and heir at law of JAMES KELLY late of said Allegany County who died seized and possessed of at large real and personnel Estate and whereas the said PATRICK KELLY has sold all his right to the said interest in and to said real and personal estate unto the said CHRISTOPHER KELLY at and for the consideration hereinafter mentioned and the said CHRISTOPHER KELLY having complied with the sums of purchase they the said PATRICK KELLY and CATHARINE KELLY his wife are willing to execute these presents Now therefore this Indenture witnesseth that for and in consideration of the promises so made in further consideration of the sum of two thousand dollars current money of the United States to whom the said PATRICK KELLY and CATHARINE KELLY his wife in hand paid by the said CHRISTOPHER KELLY at and before the sealing and delivery of these presents the receipt of which is hereby acknowledged by the said PATRICK KELLY and CATHARINE KELLEY his wife they the said PATRICK KELLY and CATHARINE KELLY his wife have given granted, Bargained and sold aliened enfeoffed released conveyed and confirmed and by these presents do give grant bargain and sell alien enfeoff release convey and confirm unto the said CHRISTOPHER KELLY his heirs and assigns all those several tracts part of tracts and parcels of land lying and being in Allegany County in the sate of Maryland of which JAMES KELLY late of said Allegany County died seized and possessed distinguished and known by the following names and descriptions that is to say "Moore's Amendment containing two hundred and nine acres of land more or less and part of White Oak Swamp containing Eleven Acres of land more or less being the two tracts or parcels of land mentioned and described in the deeds of conveyance from BEN S. PIGMON trustee to the said JAMES KELLY deceased bearing date the twenty seventh day of May in the year one thousand eight hundred and thirty three and Recorded in Liber AB No 8 folio 311 & 320 (this is not clear) one of the land Records of said Allegany County Also the tract called "___" patented to the said JAMES KELLY containing according to the patent one hundred and forty nine acres and one half And Also the tract called "___" patented to the said JAMES KELLY containing according to the patent eighty five acres and a half acre Also the tract called "Cherry Orchard" patented to the said JAMES KELLY Containing according to the patent eighty one acres and a half Also the tract called "M&G" patented to the said JAMES KELLY containing according to the patent forty six acres and three eights of an acres Also the tract called "___" patented to the said JAMES KELLY containingaccording to the patent eleven acres and one fourth of an acre Also the tract called "___" Patented to the said JAMES KELLY containing according to the patent nine acres and a half acre Together with all and singular the Buildings improvements ways, waters, water courses Rights members priviliges advantages and appurtenances thereto belonging or in any wise appertaining and ___ the Estate Right title and interest ___ property claim and demand whatsoever at Law and in Equity of them the said PATRICK KELLY and CATHARINE KELLY his of in and to the same. To Have and To Hold the said several Tracts parts of tracts or parcels of lands an premises herein before mentioned and described with the appurtenances thereunto belonging unto the said CHRISTOPHER KELLY his heirs and assigns to the only proper use of the said CHRISTOPHER KELLY his heirs and assigns forever and this Indenture further witnesseth that the said PATRICK KELLY and CATHARINE KELLY his wife have for the consideration above mentioned Bargained sold and confirmed and do hereby bargain, sell, transfer assign and convey unto the said CHRISTOPHER KELLY his heirs executors administrators and assigns all the Right title and interest both at Law and in Equity of them the said PATRICK KELLY and CATHARINE KELLY his wife of in and to all the personal estate of which the said JAMES KELLY died possessed whomever the same may be ____ or in whatsoever form it may exist In witness whereof the said PATRICK KELLY and CATHARINE KELLY his wife have hereunto set their hands and seals on the day and year first above written.

This Indenture made this eight day of February in the year of our lord one thousand eight hundred and forty one between PATRICK KELLY and MARY JANE his wife of Allegany County and State of Maryland of the one part and JOSIAH ENGLAN of the same county and State of the other part wit: Witnesseth that the said PATRICK KELLY and MARY JANE his wife for and in consideration of the sum of six hundred dollars current money of the United Sates to them the said PATRICK KELLY and MARY JANE his wife in hand paid by the said JOSIAH ENGLAN at or before the sealing or delivery of these presents the receipt whereof the said PATRICK KELLY and MARY JANE his wife do hereby acknowledge thereof do release acquit and discharge the said JOSIAH ENGLAN his heirs executors administrators by those presents they the said PATRICK KELLY and MARY JANE his wife have granted bargained and sold and by those presents do grant bargain and sell unto the said JOSIAH ENGLAN his heirs and assigns all that part of Lot number one hundred and eighty five (No 185) on the East side of WILLS CREEK in the Town of Cumberland in the County and State aforesaid which is bounded and described as follows; Beginning for the said part of said Lot hereby bargained and sold at the end of forty feet on the first line of said lot and running thence with M___ Street South forty two degrees and one fourth of a degree East twenty six feet to the end of said first line then South forty eight degrees West one hundred and eighty four feet to Wills Creek then up and with said creek North fifty four degrees and three fourths of a degree West twenty six feet and six inches more or less to a line drawn South forty eight degrees West from the place of Beginning then by a straight line to the place of beginning which said part of said Lot hereby bargained and sold was sold and conveyed to the said PATRICK KELLY by JAMES SMITH and ANN ELIZA his wife by deed bearing date on the twenty sixth day of May in the year of our Lord one thousand Eight hundred and forty and recorded in Libers AB, No. AA, folio 390, 391 & 392 one of the land records of Allegany County aforesaid as by reference thereto will more fully appear together with all and Singular the improvements advantages profits and appurtenances thereunto belonging or in any wise appurtaining To have and to hold unto him the said JOSIAH ENLAN his heirs and assigns forever and also all the estate right title use trust property claim and demand whatsoever of them the said PATRICK KELLY and MARY JANE his wife of in and to the aforesaid Lot and premises hereby bargained and sold and to every part and parcel thereof to the only proper use and benefit of him the said JOSIAH ENGLAN and of his heirs and assigns forever and to and for no other use intent or purpose whatsoever and the said PATRICK KELLY and MARY JANE his wife for themselves and their heirs do hereby convenant grant promise and agree to and with the said JOSEPH ENGLAN his heirs and assigns that they the said PATRICK KELLY and MARY JANE his wife and their heirs the said

At the request of JOHN KELLEY the following Deed was recorded May 25th 1854.

This Indenture made this fourteenth day of Mary in the year of eighteen hundred and fifty four between PATRICK McLAUGHLIN and ELEANORA his wife of Baltimore City and State of Maryland of the one part and JOHN KELLEY of Allegany County and said state of the other part Witnesseth that for and in consideration of the sum of Twenty five dollars current money of the United States to them in hand paid by the said JOHN KELLEY at and before the sealing and delivery of these presents the receipt whereof the said PATRICK McLAUGHLIN and ELEANORA his wife have granted bargained and sold and by these presents do grant bargain and sell unto the said JOHN KELLY all that lot piece or parcel of land lying and being in Allegany County Maryland and being all that part of a tract of land called "Bear Camp" now owned by the said PATRICK McLAUGHLIN and ELEANORA his wife which lies west of a road leading from Cumberland to Salisbury beginning for said lot being at the end of the second line of PATRICK HORANS? lot and running in continuation of said line north forty five degrees east seven and one eighths perches then to a straight line to a white oak stump which stands at the distance of twenty two feet ___ the white oak tree at the South east end of the stone house then to the end of the first line of PETER CALLAGHAN's lot and then unto the first line of PETER CALLAGHAN's lot and the second line of PATRICK HOARES? lot north forty five degrees west six and a half perches to the beginning containing one fourth of an acres more or less being the same lot conveyed by FRANCIS DEAN and MARY his wife to said PATRICK McLAUGHLIN by a deed bearing date the eleventh day of November eighteen hundred and forty two and recorded July the eighteenth eighteen hundred and forty three in Liber AB No. DD Folio 374, 375, & 376 one of the Land records of Allegany County Maryland. Together with all and singular the improvement advantages profits and appurtenances thereon To have and to hold unto him the said JOHN KELLEY his heirs and assigns forever.
And also all the estate right title use trust property claim and demand whatsoever of them the said PATRICK McLAUGHLIN and ELEANORA his wife of in and to the said lot and premises hereby bargained and sold and to every part and parcel thereof to the only proper use and benefit of him the said JOHN KELLEY and of his heirs do hereby covenant promise and agree to and with the said JOHN KELLEY his heirs and assigns that they the said PATRICK McLAUGHLIN and ELEANORA his wife and their heirs and assigns and ___ all and every person or persons whatsoever claiming from by or under them shall and will covenant and forever defend.

This Indenture made the eighteenth day of February eighteen hundred and fifty six Between PATRICK W. KELLY of Allegany County in the State of Maryland of the one part and CHRISTOPHER KELLY of said County and State of the other part Whereas the said PATRICK W. KELLY is a son and heir of JAMES KELLY late of said county who died seized and possessed of a large real and personal estate and whereas the said PATRICK W. KELLY has sold all his right title and interest in and to said real and personal estate unto the said CHRISTOPHER at and for the consideration hereinafter mentioned and the said CHRISTOPHER KELLY having complyed with the terms of purchase the said PATRICK W. KELLY is willing to execute ___presents. This Indenture made this twenty ninth day of January in the year of Our Lord one thousand eight hundred and seventeen between SUSANNA MARTIN formerly SUSAN KELLY of Bedford County and state of Pennsylvania of the one part and JONATHAN HENDERICKSON of the county, and state aforesaid of the other part. This Indenture made this nineteenth day of November in the year of our Lord one thousand eight hundred and eleven Between THOMAS KELLY of Allegany County and State of Maryland of the one part and JAMES KELLY of the County and State aforesaid of the other part. Thomas J. McKaig to James Kelley

At the request of JAMES KELLEY the following deed was recorded February 21st 1850.

This Indenture made this twenty ninth day of January in the year of our lord one thousand eight hundred and fifty between THOMAS J. McKAIG trustee as hereinafter mentioned of Allegany County and State of Maryland of the one part and JAMES KELLY of the county and state aforesaid of the other part Whereas a certain BEAN? S. PIGMAN late of Allegany County deceased in his life time to wit on the 18th day of June in the year 1845 by his deed of that date sold and conveyed all his real estate lying and being in the county of Allegany and state of Maryland to HANSON B. PIGMAN and NATHANIEL PIGMAN their heir and assigns in trust to sell and dispose of the said real estate for the purpose of paying the debts of the said BEAN S. PIGMAN and whereas the said HANSON B. PIGMAN and NATHANIEL PIGMAN during the time they were acting as trustee under said deed by virtue of the power vested in them by said deed of trust on the 21st day of February 1846 by agreement in writing sold unto the said JAMES KELLY his heirs and assigns the following described tracts pieces or parcels of land lying on said Allegany County and part of the said real estate described in said deed of trust to them from the said BENE S. PIGMAN deceased to wit all that part of the late BEAN S. PIGMAN'S old town farm known as the "Shellhorn Place" also the tract of land called "Rapho" containing fourteen and three fourths acres also part of a tract of land called "Pomona" beginning for the said part at the end of the 22nd line of the whole tract and running with the twenty third, twenty fourth, twenty fifth, twenty sixth, twenty seventh, twenty eight, twenty ninth and to the end of the thirty three perches on the thirteenth line and to the end of the twenty eight line of the original called "Prathers Addition" and with the twenty eight twenty seventh, twenty sixth, twenty fifth, twenty fourth and twenty third lines of the original called "Prathers Addition" home to the beginning containing forty seven acres and one fourth of an acre at and for the price or sum of twenty seven hundred and fifty dollars current money and whereas afterwards the said HANSON B. PIGMAN and NATHANIEL PIGMAN filed their petition in Allegany County Court as a Court of Equity paying the said Court ___ and discharge the said HANSON B. PIGMAN and NATHANIEL PIGMAN from the duties of completing said tract and to appoint another Trustee within stead Whereupon the said Court by a decree dated on the 24th day of May 1847 released and discharged the said HANSON B. PIGMAN and NATHANIEL PIGMAN from the said trust and appointed the said THOMAS J. McKAIG in their place with full power and authority to complete the same and to execute al the power and authority in selling and disposing of said real estate of BENE S. PIGMAN which were specified in said deed of trust executed by him on the said 18th day of June 1845 the said HANSON B. & NATHANIEL PIGMAN all of which will more fully appear by reference to said Petition decree &c in No 573 on the Chancery Docket of said Court and whereas the purchase money for the above described tracts of land has been fully paid by the said JAMES KELLEY a part being paid to the said HANSON B. & NATHANIEL PIGMAN during the time they acted as Trustees as aforesaid and the balance of the purchase with interest being the sum of eleven hundred and sixty dollars and fifty cents having been paid by the said JAMES KELLY to the said THOMAS J. McKAIG Trustee as aforesaid he is hereby authorized to execute these presents. Now this indenture Witnesseth that the said THOMAS J. McKAIG Trustee as aforesaid for and in consideration of the premises and for the further consideration of the sum of five dollars current money in hand paid to him by the said JAMES KELLEY at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained and sold conveyed released and confirmed and by these presents doth grant bargain and sell convey release and confirm unto the said JAMES KELLY his heirs and assigns all the above described tracts pieces or parcels of land as hereintofore named and described together with all and singular the buildings improvements ways waters privileges and advantages and appurtenances thereunto belonging or in any wise appertaining To have the To Hold the said above described tracts or parcels of land and premises with the appurtenances unto the said JAMES KELLEY his heirs and assigns to the only proper use of the said JAMES KELLY his heirs and assigns forever ___ cleared and discharged from all claim and demand whatsoever of the said BEAN S. PIGMAN and all persons whatsoever claiming under from or by him.

Know all men by these presents that we JOSEPH WADSWORTH and JOHN WADSWORTH of Fiatt (Fayette) County, State of Pennsylvania and THOMAS KELLY of Allegany County, Maryland have this day sold, bargained and conveyed all their right title Interest and claim of Lot number Seven on Bedford Street in Blocker Addition to the town of Cumberland unto GEORGE BLOCHER his heirs and assigns for and in consideration of the sum of twenty dollars current money to them in hand paid by the said BLOCHER before the sealing and delivery of these presents the receipt whereof they do hereby acknowledge and by these presents do sell bargain and convey all their right title interest and claim of the aforesaid lot unto the said BLOCKER his heirs executors administrators and assigns. As witnesses our hand and seals their 17th day of January 1809.

This Indenture made this nineteenth day of December in the year of our Lord one thousand eight hundred and thirty one, Between William W. Hoye of Allegany County State of Maryland of the one part and David Kelly of the County and State aforesaid of the other part, Witnesseth that the said William W. Hoye for and in consideration of the sum of Three hundred dollars current money of the United States to him in hand paid by the said David Kelly before the sealing and delivery of these presents the receipt whereof he the said William W. Hoye and his heirs the said tract or parcel of land and premises hereby granted bargained and sold and every part and parcel thereof with the appurtenances thereunto belonging to him the said David Kelly his heirs and assigns against him the said William W. This Indenture made this twenty fifth day of March in the year of our Lord one thousand eight hundred and fifty four between WILLIAM LOGSDON and ELIZABETH his wife of Allegany County in the State of Maryland of the one part and JOHN KELLEY of the said State and county of the other part. This Indenture made this thirteenth day of April in the year Eighteen hundred and twenty one. Between William McMahon of Allegany County and State of Maryland of the one part and James Kelly of the same County and State of the other part. Witnesseth that for and in consideration of the sum of two hundred dollars current money to him in hand paid the receipt whereof hereby acknowledged he the said William McMahon hath granted bargained and sold and by these presents doth grant bargain and sell unto the said James Kelly his heirs and assigns all that lot or portion of ground in the town of Cumberland known by Lot number forty eight. Beginning for said Lot at a stone No 48 standing on the north side of Plea Street and at the end of the first line of Lot No 47 and running thence with said street North Eighty three degrees and one half degree West one hundred and one feet to a stone standing on the east side of Walnut Alley, North six and one half degrees east one hundred and seventy one feet, South Eighty three and one half degree, East one hundred and one feet to Lot 47 thereby a straight line to the beginning. Together. At the request of JAMES KELLY this Deed was Recorded the 27 May 1833

This Indenture made this twenty seventh day of May in the year of Our Lord one thousand eight hundred and thirty three, between B. S. PIGMAN Trustee of Allegany County, State of Maryland of the one part and JAMES KELLY of the County and state aforesaid of this other part witnesseth whereas by Decree of Allegany County Court as a Court of Chancery the said B. S. PIGMAN was appointed Trustee to sell the Real Estate of WILLIAM MOORE late of Allegany County deceased that in ___ of said decree the said B. S. PIGMAN on the fifth day of December in the year of our Lord one thousand eight hundred and twenty eight sold and disposed of at Public Sale as directed in said Decree the following real estate of which the said WILLIAM died seized, in the Allegany County to JAMES KELLY aforesaid "Moore's Admendment" containing two hundred and nine acres of land more or less according to the Original Patent thereof from the Sate of Maryland to the said WILLIAM MOORE "Part of White Oak Swamp" containing eleven acres of land, more or less conveyed to said WILLIAM MOORE by JACOB LAPP by Deed bearing date the second day of March one thousand seven hundred and ninety two, and recorded among the said records of Allegany County which Real Estate was struck off to said JAMES KELLY for the price of twenty eight hundred and one dollars, which said, purchase money has been full paid and the said B. S. PIGMON is authorized to make this deed, Now this Indenture therefore witnesseth that the said B. S. PIGMON in consideration of the premises and also of the further sum of one dollar current money of the United States to him in hand paid at or before the Sealing and delivery of these presents the receipt whereof is hereby acknowledged and himself to be therewith paid hath granted bargained, sold aliened released and confirmed and by these presents doth grant bargain sell alien release and confirm unto the said JAMES KELLY his heirs and assigns forever all the Tracts of land and Real Estate aforesaid to contain in quantity of Estae all the right title and interest of the said William MOORE and of his Devisees under and by virtue of the last will and testament aforesaid to the said JAMES KELLY his heirs and assigns forever;

JACOB BLUBAUGH to JACOB UHL

At the request of JACOB UHL the following Deed was recorded June 14, 1828

This Indenture made the ninth day of May in the year of our Lord one thousand eight hundred and twenty eight between JACOB BLUBAUGH of Allegany County and State of Maryland of the one part and JACOB UHL of Somerset County and State of Pennsylvania of the other part. Witnesseth that the said JACOB BLUBAUGH for and in consideration of the sum of forty Dollars to him in hand paid by the said JACOB UHL before the sealing and delivery of these presents the receipt whereof the said JACOB BLUBAUGH doth hereby acknowledge and himself to be therewith contented and paid and the said JACOB UHL his heirs executors and administrators therefrom doth acquit and forever discharge hath granted bargained and sold aliened enfeoffed Conveyed and confirmed and by these presents doth give grant bargain sell alien enfeoff convey unto the said JACOB UHL his heirs and assigns forever all that tract or parcel of land contained within the following courses bounds and distances it being part of a tract Called Lubberland lying in Allegany County aforesaid and beginning for the part sold and hereby ment to be Conveyed at a hickory tree standing ________ to the edge of Jennings run below UHL's Mill and running thence north forty six degrees west eight perches South fifty eight degrees West twenty six perches to a rock South twenty four degrees East thirty five perches North eighty eight degrees East thirty two perches South twenty four degrees East twenty perches North sixty six degrees East eleven perches to the Beginning of CHARLES MILLERs at a _______ ________ Closed to the ________ ______ then by a ______ ______ Line to the Beginning containing nine acres and eighteen perches of land more or less together with the advantages and appurtenances to the same belonging or in any wise appertaining and all the estate right title interest use trust possession property claim and demand of the said JACOB BLUBAUGH in law or in equity to the same to have and to hold the said tract or parcel of land and premises with the rights members and appurtenances to the said JACOB UHL his heirs and assigns to the only proper use and behoof of him the said JACOB UHL his heirs and assigns and to no other intent or purpose whatsoever and the said JACOB BLUBAUGH doth hereby for himself and his heirs covenant promise grant and agree to and with the said JACOB UHL his heirs and assigns to warrant and defend to him and them the land above mentioned to be granted ___ the said JACOB BLUBAUGH and his heirs and all persons claiming or to claim under him or them or any of them in Witness whereof I have hereunto set my hand and affixed my seal the day and year as above written.

State of Maryland Allegany County to wit:
On the ninth day of May eighteen hundred and twenty eight personally came before the subscriber two of the Justices of the peace for the County aforesaid JACOB BLUBAUGH mentioned within and acknowledged the within instrument of writing to be his act and deed and the Land and premises therein mentioned to be the right and estate of JACOB UHL his heirs and assigns according to the true intent and meaning thereof. And at the same time Came also _____ wife of the said JACOB BLUBAUGH and being by us privately examined apart and out of the hearing of her said husband id release and relinquish her right of Dower of in and to the said land mentioned in the foregoing Deed or Instrument of writing and declared that she did the Same freely of her own free will without being induced thereto thro fear or threats of ill usage from her said husband or thro fear of his displeasure according to the Act of Assembly in such case made and provided.

JOHN UHL and CATHERINE his wife to JOHN MATTINGLY SENR.

At the request of JOHN MATTINGLY SENR. The deed was Rec'd the 6th Sept 1832
This Indenture made this Sixth day of September in the Year of our Lord Eighteen Hundred and Thirty Two, Between JOHN UHL and CATHERINE his wife of Allegany county in the State of Maryland of the one part and JOHN MATTINGLY SENIOR of the county and State aforesaid of the other part, witnesseth that the Said JOHN UHL and CATHERINE his wife for and in consideration of the Sum of Eight Hundred twenty dollars current money of the United States to him in hand paid by the Said JOHN MATTINGLY SENR before the Sealing & delivery of these the receipt whereof the said JOHN UHL and CATHERINE his wife doth hereby acknowledge and from every part and parcel thereof, doth hereby acquit, exonerate and discharge the said JOHN MATTINGLY SEN his heirs executors and administrators he the said JOHN UHL and CATHERINE his wife hath granted, bargained and Sold, aliened enfeoffed and Confirmed and by these presents doth grant, bargain, sell, alien, enfeoff and confirm unto the Said JOHN MATTINGLY SENR his heirs and assigns all that Tract or parcel of land contained in the following courses & distance and to wit, Being part of lot no. 3363 part of lot No. 3360 part of Lubberland and Part of Brandy, Beginning at the end of the Fourth of lot No. 3363 and running thence north ninety & three fourth perches North eighty Seven degrees East fifty eight perches North fifteen degrees East three perches, South Seventy seven East Sixty seven perches, South seventeen degrees, West seven and one fourth of a perch South Seventy seven degrees East forty perches North Seventy five degrees East thirty eight perches to the end of fourteen & one fourth of a perch on the fourth line of a Tract of land called "White Oak Point" and with it South three degrees East thirty five and three fourths of a perch, South sixty eight degrees west fifteen perches North eighteen degrees West four perches, South Sixty eight degrees West forty eight perches South fifty degrees, West twelve perches to the fifth line of "White Oak Point" and with it South Sixty eight degrees West Six perches to the given line of lots rectified and with it South eighty Six & a quarter degree west Sixty Seven and three fourths of a perch to lot No. 3363, South four perches then with a straight line to the beginning containing Eighty one and one quarter of an Acre more or less together with the advantages and appurtenances to the Same belonging or in any wise appertaining and all the Estate right title, interest, use trust, possession property claim and demand of the said JOHN UHL and CATHERINE his wife in Law and equity to the Same, To Have and To Hold the said tract of Land and premises with the rights hereditaments appurtenances to the said JOHN MATTINGLY SENR. his heirs and assigns unto no other intent or purpose whatsoever and the said JOHN UHLE and CATHERINE his wife doth hereby for him self & his heirs covenant promises grant and agree to and with the JOHN UHLE & CATHERINE his heirs and assigns to warrant and defend to him and them the land within mentioned to be granted against the said JOHN UHLE and CATHARINE his wife and his heirs and all persons claiming or to claim under him or them or any of them.

In Witness whereof we have hereunto set our names and affixed our Seals the day and year before written.

On the Sixth day of September 1832, before us the Subscribers two Justices of the peace of the State of Maryland in and for Allegany County aforesaid personally appeared JOHN UHLE the grantor within named and acknowledged the aforegoing Deed or Instrument of writing to be his act & Deed for the purposes therein mentioned we further certify as Justices aforesaid that on the day and year aforesaid at the County aforesaid Come, CATHARINE UHLE wife of the said JOHN UHLE Out of the hearing of her husband did Sign and seal the aforegoing Deed, and having by us examined out of the presence & hearing of the husband whether she doth execute and acknowledge the same freely and voluntarily and without being induced to do so by fear or threats of or ill usage by her husband acknowledged that the Signed, Sealed and Executed the same Deed freely and voluntarily and without being induced to do so by fear or threats of or ill usage by her husband,
