John W. Merhoff, as executor of the last will and testament of Casper Heinrich Merhoff, deceased, respondent, vs. Herman Merhoff and Maria Louisa Merhoff, appellants.
It is not competent for a party to an action to testify as to the manner of the payment of the consideration in a deed, the grantee of which is deceased, on the ground that it calls for oral admissions and conversations, although the fact of payment may be stated.

County of Sibley,
In Probate Court.
In the Matter of the Estate of Louis H. Borchert, Decedent.
The State of Minnesota To Theodore Borchert, Lena Mielke, Richard Borchert, Amanda Henke, Eddie Borchert, Alma Borchert and all persons interested in the mortgaging of certain lands belonging to said decedent. The petition of Theodore Borchert as representative of the above named estate, being duly filed in this court, representing that it is necessary and for the best interests of said estate and of all interested therein that certain lands of said decedent described therein be mortgaged and praying that a license be to him granted to mortgage the same:
Now Therefore, you, and each of you, are hereby cited and required to show cause, if any you have, before this court, at the Probate Court Rooms in the Court House in the Village of Gaylord, County of Sibley State of Minnesota, on the 16th day of December 1922, at two o'clock P. M., why the prayer of said petition should not be granted.
Witness the Judge of said Court, and the seal of said Court, this 21st day of November 1922.
