St. vs Henry Kennedy
for assaulting N.H. Rogers, of Mercer county, at Kennedy's Hotel last March and for which the Grand Jury found a true bill under the 33d section of Chapter 200, General Statutes, a decision was rendered at this term of our circuit court.  Mr. Kennedy plead guilty and was fined one hundred dollars.  We have no dispostion to censure those in authority, or inpugn the motives of any one; but we very much mistake our judgment if a just public will not regard the fine as a very rivial punishment when compared with the enormity of the crime.
The punishment was the lowest possible recognized by law- while it might have been five years in the penitentiary.  The good of society demands a just enforcement of the laws, and when that is done every good citizen should bow in humble obedience.  We know it will be done in this case; but we are compelled to think that we speak the sentiment of public opinion when we say that the demands of justice have not been satisfied.
