WILL OF MARCELINE (BALTEZOR) McMILLIN -- 11/29/ 1883
 


In the name of God Amen - I Marceline McMillin being of sound mind but suffering of bodily infirmities do make and publish this as my last will and testament. I devise such that my funeral expenses be paid and all other just debts and then the residue and balance of my estate shall be equally divided between my four children John McMillin, Wm. A. McMillin, Samuel T. McMillin, and Robert Lee McMillin subject however to the following condition - all of said children now being of tender age it is my desire that they shall not receive their share until they have severally come ofage and if either of said before named children should die then the share of said deceased child shall be divided among the survivors. It is my will and desire that any estate that I may leave shall be held in trust by my executor herein after named so that my former husband shall never under any circumstances or by any means control any part of the legacies above mentioned until after the conditions of this will have been fully complied with for the purpose of having my memory perpetuated to my ....

I hereby authorize my said executor to cause to be placed upon my grave suitable tombstones which shall be paid for out of my estate, it is my desire that my furniture and other household goods be sold by said executor and the proceeds applied in accordance with the provisions of this will before set forth. I further authorize my executor to pay the sum of five dollars for Masses to be said for the repose of my soul, or any sum that he may deem right and proper for said purpose. I hearby appoint and constitute my beloved brother, Narcis Baltezor, as executor of this my last will and I further desire that he shall not be required to give any bond whatsoever such as executor.

Be it remembered on this the eighth day of March AD 1884 before me John T. Powell, Judge of the Probate Court, held in and for the county and State aforesaid, personally appeared Ernst Radell and John C. Howes who are the subscribing witnesses to the annexed will of Marceline McMillin deceased, and being by me first duly sworn, depose and say that the said Marceline McMillin the testator, subscribed the same in their presence and published and declared said will or instrument of writing to be his last will and testament, and at the time of signing the same she the said testator was of sound and diposing mind, and more than twenty-one years of age and that said documents attested said will as witnessed thereto, by subscribing their names to the same in the presence of the testator and of each other, and at the request of the said testator.
