The Will of Henry J. Walton   - 1850
 

I Henry Walton, of the county of St. Louis and State of Missouri, being of
sound mind, do make, declare and proclaim this to be my last will and
testament and hereby revoking all other will or wills or testaments that I
may have made.

I hereby give and bequeath to my daughter Lavina intermarried with John
Sparks, the following described tract, piece or parcel of land, that is to
say, I give and bequeath to my said daughter Lavina, a certain tract, piece
or parcel of lands lying and being in the county of St. Louis and State of
Missouri, with all the appurtenances appertaining to the same, and being the
same tract of land now occupied by my said daughter Lavina, which said tract
of land is bounded as follows: beginning in the? Of the? St. Charles Road on
the line between Charles C. Loring and the undersigned Henry Walton and
running with the western boundary line of the undersigned to the north west
corner of the land belonging to the same, thence running east with the
northern boundary line of the said undersigned to the northeast corner of
the field now occupied by John Sparks, the husband of my aforesaid daughter
Lavina, thence running with the fielded fence to the lane that runs past the
barn of the land John Sparks and tenants on or near the St. Charles Road
thence running with the St. Charles Road to the place of beginning.

I also give and bequeath to my aforesaid daughter Lavina a certain tract,
piece or parcel of land, situated in the county of St. Louis and State of
Missouri, and being the same tract, piece or parcel of land, which has been
and is now occupied by a certain Lilly Ann Long the widow of William Long,
formerly of the state and county aforesaid now deceased. The above described
property given and bequeathed to my aforesaid daughter Lavina, upon the
conditions stated below, and upon none other, Viz: That she the said Lavina
pays or caused to be paid, a certain mortgage held by Louis Clote held
against the above described property and also satisfies as socours to be
satisfied, the following named promissory note, made payable to the County
of St. Louis, for five hundred dollars, also one other promissory note, made
payable to Col. Brandt for five hundred dollars, and one other promissory
note made payable to State Bank of Missouri for seven hundred dollars.

I also give and bequeath to Charles Henry, Harvey Holman and William A.
the children of my deceased son William Russell Walton, the following
described tract, piece or parcel of lands situated in the county of St.
Louis and state of Missouri, containing fifty acres more or less with the
appurtenances appertaining to the same and being the same tract piece or
parcel of lands that ajoin lands of James H. Lucas on the east, land of the
western adjoining Henry Walton on the south and west and land of the heirs
of John Walton on the north and being the same tract, piece or parcel of
land now occupied by Hannah Ann Walton the widow of the aforesaid William
Russell Walton.

I also give and bequeath to my daughter Charlotte, intermarried with John
Lay, a western tract, piece or parcel of land situated in the county of St.
Louis and state of Missouri containing about forty acres and adjoining land
of James Walter on the east also adjoining the New Madrid location of the
undersigned on the west and south and adjoining a forty acre tract of the
undersigned on the north and on the eastside southwest adjoining land of
James Walton.

I also give and bequeath to my daughter Lorinda intermarried with Robert
Street a certain piece, parcel or tract of land situated in St. Louis county
and state of Missouri containing fifty acres and being part and parcel of a
New Madrid claim entered in the name of John Baptist St. Marie the same to
be taken off the eastern half of the tract of land as the said tract is now
occupied by the undersigned and the aforesaid fifty acres to include the
Mansion House in which the undersigned now resides as well as all other
appurtenances included and belonging to the said fifty acres of land.

It is however to be expected??? That it is my will and pleasure that my wife
Rebecca Walton????? Interest in the aforesaid fifty acres of land?????
Containing and belonging to the same during her natural life??? Let or
hindrance?

It is also my will and pleasure that the residue of my farm not including in
the preceding bequests is to be exclunerly appropriator to the side and
benefit of my wife Rebecca Walton, during her natural life, and that she
have full power and authority to dispose of any and all precluded from the
same as she, in her judgment may deem right & proper.

And further it is my will and pleasure that my wife Rebecca Walton be
authorized and hereby is empowered to ???? Of any proceeds that may arise
from ????

To her during her natural life and if???? Much of the said land, bequeaths
to her??? As may be needed to meet any just claims that may be legally
established against my estate.

It is also my will and pleasure that any property not bequeathed to my
children and their heirs and now belonging to me shall after the death of my
wife Rebecca Walton be equally divided among my several heirs who may be
living, then & share alike.

Provided however that any heirs who may be indebted to me, either by note
or by book account, shall either pay the same or satisfy the remaining heirs
in such a manner as to equalize in value the property above mentioned.

And further, I hereby constitute and approve my said wife Rebecca Walton and
my son-in-law Robert Street to be the executors of my last will and
testament, revoking and annulling all others made by me ????
