PROOF EXHIBITED.
Seabury Williams was murdered May 16, 1861, and killed at the battle of Antietam September 17, 1862.
Marriage:
It is shown, that Rev. F. S. Gaylord who married the parties is dead, and there is no record evidence of the same. One credible witness certifies that she was present and witnessed the ceremony. Other persons that the parties lived together as man and wife.

Steuben County} SS.     On this Eleventh day of May A.D. One Thousand eight hundred and Sixty three, personally appeared before me Iva. P. Barney, a Justice of the Peace of the town of Wheeler Nancy M. Williams a resident of Wheeler in the County of Steuben and State of New York aged thirty eight years, who being first duly sworn according to law doth on her oath make the following declaration in order to obtain the benefit of the provision made by Act of Congress approved July 14th 1862. That she is the widow of Seabury Williams who was a private in Company A. commanded by Capt Theodore Schlick in the Twenty Third Regiment of New York State Volunteers in the War of 1861 who was killed in the battle of Antietam Sept. 17th 1862. She further declares that she was married to the said Seabury Williams on the ninth day of June in the year 1845 one thousand eight hundred & forty five. That her husband the aforesaid Seabury Williams died on the day above mentioned and that she has remained a widow ever since that period as will fully appear by refference to the proof hereto annexed. She also declares that she has not in any manner been engaged in or aided or abetted the rebellion in the United States.

Marshal, and Abram Blakesby, Residents of Wheeler Steuben Co and State of New York whom I certify to be respectible and entitled to credit and who being by me duly sworn say that they were present and saw Nancy M. Williams sign her name to the foregoing declaration and they further swear that they have every reason to believe from the appearance of the applicant and their acquaintance with her that she is the identical person she represents herself to be and that they no interest in the prosecution of this claim.

     I have the honor to acknowledge the receipt from your Office of application for Pension No. 21,867, and to return it herewith, with such information as is furnished by the files of this Office.
     It appears from the Rolls on file in this Office, that Private Seabury Williams was enrolled on the 16th day of May, 1861, at Elmira NY in Co. A, 23rd Regiment of New York Volunteers, to serve two years, or during the war, and mustered into service as a private on the 16th day of May, 1861, at Elmira NY, in Co. A, 23rd Regiment of New York Volunteers, to serve two years, or during the war. On the Muster Roll of Co. of that Regiment, for the months of September & October, 1862, he is reported "Killed at the battle of Antietam Sept. 17th 1862"

County of Steuben, On this 15th day of September 1863 personally appeared before me Eliza Ann Taylor a resident of Wheeler, N.Y. who being by me duly sworn says that she was present & saw Nancy M. Williams married to Seabury Williams.. That they were married on 9th day of June 1845 at Prattsburgh, in said County by the Rev. Flavel S. Gaylord. That there is no second evidence of said marriage. That the Rev. Flavel S. Gaylord is dead. That the said Seabury Williams & Nancy M. Williams his wife lived together as husband and wife from the time they were married as aforesaid until the day of his death. That this deponent is the only living witness that was present at said marriage. That the said Nancy M. Williams has remained a widow since her Husband's death & is so reputed to be. That she has never heard the fact of this marriage disputed or questioned.

Clark Bell & Andrew P. Overmiser being duly sworn say each for himself that they are well acquainted with Wid Nancy M. Williams & have known her for seven years that they were acquainted with Seabury Williams her late Husband for same length of time. They lived together as Husband & Wife during that time. That they never heard the fact of this marriage disputed or questioned. That is was the genuine reputation and understanding in the Town of Wheeler, N.Y. where they resided. That they were married & lived together as Husband & Wife and the said Andrew P. Overmiser says that he has known the said Nancy M. Williams & Seabury Williams since they were married in 1845. That they have lived together as Husband & Wife from that time until the day of her Husband death. That he never heard the fact of this marriage disputed or questioned. That the said Nancy M. Williams has remained a widow since Husbands death.

Williams who being by me duly sworn says she is the widow of Seabury Williams who was a private in Co. A. 23d New York Regiment of Volunteers who was killed in the battle of Antietam in Maryland on 17th September 1862.
     She futher declares that she was married to the said Seabury Williams on the 9th day of June 1845 by Rev. F. S. Gaylord at Prattsburg N.Y. That there is no record evidence of her said marriage. That the Rev. F. S. Gaylord is now dead.
     That the following are the names, date of birth and place of residence of the children of her deceased husband who are under sixteen years of age at the time of his death.

     That she hereby appoints Charles F. Kingsley of Bath her true and lawful attorney to prosecute this her claim for pension & to receive the certificate to be issued therefore.

     Also personally appeared Eliza Ann Taylor and Emmet Taylor residents of Wheeler, Steuben County New York, who being by me duly sworn say that they were present & sure Nancy M. Williams sign her name to the foregoing declaration. That the said Nancy M. Williams was married to said Seabury Williams on the 9th day of June 1845 at Prattsburgh N.Y. by the Rev. F. S. Gaylord. That the Rev. F. S. Gaylord is now dead. That there is no record evidence of said marriage. That the said Seabury Williams & Nancy M. Williams lived together as man & wife from the time of their said marriage until the day of his death. That the said Seabury Williams was a private in Co. A 23d New York Volunteers & was killed in the battle of Antietam in Maryland on the 17th (seventeenth) day of September 1862. That the following are the named, date of birth and place of residence of the children of the said Seabury Williams who were under sixteen years of age at the time of his death to wit.

who were all born by his said wife Nancy M. Williams. That there is no church or public record of the births of said children. That none of them have ever been baptised, and there is no record of baptism of any of said children.
     That the said Eliza Ann Taylor was present at said marriage, and saw the said Seabury Williams & Nancy M. Williams married. That the said Nancy M. Williams has remained a widow ever since her husband died as aforesaid & is refuted & understood to be his widow.
     Any they further swear that they have no interest in the prosecution of this claim.

County of Steuben ss. On this 7th day of December A.D. 1863 before me the undersigned a Justice of the Peace within & for the County aforesaid personally appeared the Rev. D. D. Gregory aged Sixty One years who being by me duly sworn deposes & says that he is a minister of the Gospel and is now the Pastor of the Presbyterian Church as Prattsburgh N.Y.
     That the Rev. F. S. Gaylord deceased was formerly Principal of Franklin Academy at Prattsburgh N.Y. and was never Pastor of any Church at that place but that he occassionally preached in the said Presbyterian Church of which deponant is now Pastor.
     That Deponent has carefully examined the records of said Church and particularly during the time when the said Rev. F. S. Gaylord was living at Prattsburgh aforesaid and he can not find any record of the marriage of Seabury Williams & Nancy M. March and there is no record in said church of the marriage of Seabury Williams and he swears that he has no interest in the prosecution of this claim.

Williams while in lawful wedlock with Seabury Williams. There is no public record of said births & said children were never baptised. That Deponent was the physician in attendance at the birth of each one of the above named children & has no interest in this claim.

     On this 18 day of August, 1864, personally appeared before me, a clerk of a Court of Record in and for the County and State aforesaid, Nancy M. Williams a resident of Wheeler in the County of Steuben and State of New York, who, being duly sworn, says she is the widow of Seabury Williams who was a private in Co. A. in the 23 Regiment of New York Vols. in the war of 1861, that she is in receipt of pension certificate No. 15898 and was las paid to include 4 day of March 1866, at the Canandaigua N.Y. agency. She makes this declaration to obtain the increase of pension to which she is entitled under th Act of Congress approved July 25 A.D. 1866, for the following named children of hers left her by her said husband at the time of his death, which were under 16 years of age, at the date of the passage of said act, and were then living, viz:

Fanny Williams born on 15 day of November 1855
Benton Williams born on 28 day of August 1858
Netta Williams born on 14 Febury 1860
     That they all reside with deponent at Wheeler N.Y. & are now living. She further declares that she has not remarried since the death of her said husband nor has she abandoned the support of any one of the children above named nor permitted any one of the same to be adopted by any other person or persons as his her or their child.
     And she hereby constitutes and appoints C. F. Kingsley of Bath New York, her true and lawful attorney, with full power of substitution, for her and in her name, to apply for and receive the increased pension to which she is entitled under the act above stated. She further states that her Post Office address is Wheeler New York

Barron, resident of above & Bath Steuben County, and State of New York, to me well known as credible persons, who being duly sworn, declare that they were present and saw Nancy M. Williams sign her name to the foregoing declaration, and that they have every reason to believe, from the appearance of said applicant, and their acquaintance with her, that she is the identical person she represents herself to be; and they further state that they know, from personal knowledge, that the above named children are children of the applicant and her said deceased husband, and that they are still living; and they swear they have no interest in this claim, either present or prospective, and that they are not concerned directly or indirectly, in its prosecution.

County of Steuben  ss.     Nancy M. Williams being duly sworn says that she is the widow of Seabury Williams late private Co. A. 23d N.Y.V. & has rec'd pension cert no. 15,898. That in her original application she stated that Zalia was born 28 May 1851 & Benton on 28 August 1858. It was a mistake & she did not intend so to state that at time she made application for her first pension. She was a good deal excited & was feeling badly on account of the loss of her husband & in giving the ages of her children she supposed the particular thing was their names & was not as particular in regards to their ages as when she made application for increase. That she stated their ages from memory without looking at any record & supposed she gave them correctly but when she made application for the increase she was very particular about their ages & looked a the record at time so she could state them accurately & the ages last given by her are correct. That Zalia was born on 28 May 1852 & Benton on 28 August 1858. That these dates correspond with her record & also with her recollection as she remembers distinctly when each of them were born.
