| The Lima News Jan. 5, 1930 The last will and testament of Amy A. Rash, Union township, was admitted to probate and record, Thursday. Last Will
and Testament OF Daniel L.
Richardson In the
name of the Benevolent Father of all, I Daniel L. Richardson of
Wapakoneta, Auglaize County, Ohio, being of sound mind and disposing
memory do make and publish this my last will and testament. First: I
direct that my just debts be paid by my Executors hereinafter named, as
soon after my death as may by them be found convenient. Second: I
give and devise to my beloved wife Agnes Richardson in lieu of years
maintenance and Dower all my household and kitchen furniture, including
beds, bedding and all personal property of every description except
monies, notes, and other credits; And also give her the sum of five
thousand dollars in money. Also the following described real estate with
all the appurtenances thereunto belonging, to wit: Commencing on the
North line of Silver Street, Wapakoneta, Ohio, At a point South 28°
East of the South West corner of the East half of lot 10 and running
thence North 3 ˝° West one hundred forty three (143) feet, thence
North 86 ˝° East sixty (60) feet, thence North 3 ˝° West One hundred
forty one and three quarters feet (141 3/40) Thence North 86 ˝° East
One hundred thirty eight and a half, (138 ˝) feet: thence South 3 ˝°
East One Hundred and twenty-five (125) feet to Silver Street, thence
South 47° West along the said side of Silver Street two hundred and
fifty-three (253) feet to the place of beginning. containing 1738 acres,
to have and to hold the same to her and her heirs and assigns forever. Third: I
give and devise to my son George W. Richardson his heirs and assigns the
following described premises to wit: Commencing on the North line of
Silver Street in Wapakoneta, Auglaize County, Ohio, at a point South 3
˝° East from the South West corner of the East half of out lot No. 10
and running thence North 3 ˝° West along the
west side of the East half of said out lot No. 10, thence three hundred
and sixty (360) feet, thence North 86 ° East eighty (80) feet, thence
South 3 ˝° East Two hundred (200) feet, thence South 86 ˝ ° West
Sixty (60) feet: thence South 3 ˝° East one hundred and forty-three
(143) feet to Silver Street: thence South 47° 10' West thirty seven
(37) feet to the place of beginning containing 1436 acres. Also, the
following described premises to wit: The North East fraction of the West
half of section thirty five (35) Township 4 (4) South, Range five (5)
East in Auglaize County, Ohio, containing sixty five (65) acres of land
more or less, to have and to hold the same so long as he lives, and at
his death to go to his children and their heirs forever. Fourth: I
give and devise to my son Simon F. Richardson and his heirs, The South
half of the North East Quarter of Section thirty five (35) Township four
(4) South, Range five (5) East in Auglaize County, Ohio, containing
eighty-three acres of land more or less. Fifth: I
give and devise to the children of my deceased daughter Elizabeth
Wheeler, the following described premises in Auglaize County, Ohio to
wit: The North half of the South East Quarter of Section thirty five
(35), Township four (4) South, Range five (5) East, except all that
lying South of the ditch and a strip five (5) feet wide on the North
side of the ditch extending from line to line, containing eighty acres
of land more or less. Sixth: I
give and devise to my daughter Alice Walkers and her heirs, in addition
to the sum of four hundred dollars heretofore advanced to her for which
I hold her receipt, the following described land to wit: The North East
fraction of the South West Quarter of said Section thirty five (35),
Township four (4) South, Range five (5) East, containing forty eight and
4/10 acres of land more or less. Seventh: I
give and devise unto my daughter Sirilla Monroe during her natural life,
and at her death to her children and their heirs, the following premises
situated in Auglaize County, Ohio to wit: The South East fraction of the
West half of Section thirty five (35), Township four (4) South, Range
five (5) East containing fifty three acres of land more or less. Eighth: I
give and devise to my daughter Frances Wheeler, and her heirs to the
following described premises in said County of Auglaize to wit: The West
fraction of the North West Quarter of Section two (2), Township five (5)
South, Range five (5) East, containing forth nine and ˝ acres of land
more or less. Ninth: I
give and devise to my Son Isaac N. Richardson and my daughter Victoria
Baker, and their heirs- estate Situated in said County of Auglaize to
wit: The North East fraction, and South East fraction of the North West
Quarter of Section 2 (2), Township five (5) South, Range five (5) East
containing ninety six and 50/100 acres of land more or less. Also the
South half of the West Half of the North East Quarter of Section two of
said Township five (5), South , Range five (5) East containing forty
acres of land more or less. Tenth: I
give and devise to my Son Daniel F. Richardson and his heirs the East
part in lot number thirteen (13) in Wapakoneta, Auglaize County, Ohio
being twenty-seven (27) feet wide, together with all the appurtenances
thereunto belonging, this is intended to include the whole of the brick
building and the walls thereof, standing on said East part of said lot
No. 13. Eleventh:
I give and devise to the children, and their heirs, of my deceased
daughter Catherine Whetstone, the West part of In lot No. Thirteen (13)
in the Village of Wapakoneta, Ohio, being twenty-three feet wide, and
not intended to include any part of the brick building standing on the
East part of said lot. Twelfth: I
give and bequeath to my daughter-in-law Cynthia A. Richardson the sum of
one thousand dollars in money. Thirteenth:
I give and bequeath to my son John H. Richardson, the sum of Ten
dollars. Fourteenth:
I direct that my Executors hereinafter appointed proceed as soon after
my death as may be to the best interests of my estate, to collect all
claims due me, and to convert all my real estate not herein specifically
devised into money, and after the payment of my just debts, the rest of
administering my Estate, and Legacies provided for in the will to divide
the residue in ten equal parts or shares, and give or pay one share or
part to each of the following named children: Simon F. Richardson, Isaac
N. Richardson, Daniel F. Richardson, George W. Richardson, Alice
Walkers, Sivilla Monroe, Frances Wheeler, and Margaret Decker, in
addition to all advancements heretofore made by me. And one part or
share to be equally divided between the children of my deceased daughter
Elizabeth Wheeler and one part or share to be equally divided between
the children of my deceased daughter Catherine Whetstone: Victoria Baker
and Ellen Baker having been heretofore (as I consider) fully provided
for by advancements in land and other valuable considerations. Fifteenth:
I further order and direct my Executors herein after named, in case any
heir, legatee or other person having any interest in my estate, either
by the terms of this said will or otherwise, make any attempt to
obstruct the due administration of my estate in accordance with the
terms of this will, or attempt to break or set aside any of the
provisions of same, there in case I direct that the money or estate
which such person would otherwise receive, be equally distributed
between my heirs who make no such attempt to obstruct or break this my
last will. Sixteenth:
I hereby nominate and appoint Molyne B. Wheeler and my son Simon F.
Richardson Executors of this my last Will and Testament hereby
authorizing and empowering them to compromise and adjust, release and
discharge in such manner as they may deem proper the debts and claims
due me. I do also authorize and empower them to sell at public or
private sale as they may deem best all my real estate not herein
disposed of, upon such terms of credit as they may deem proper, and due
to purchasers to execute and acknowledge and deliver in fee simple, and
to perform all and singular the duties of executors as required by law
and enjoined on them by the provisions of this will, and I desire that
my said executors be not required to give bond and request that the
Probate Court omit the same. And I further direct that no appointment or
inventory be made of any of the property bequeathed to my wife the said
Agnes Richardson. I hereby
revoke all former wills by me made. In testimony whereof I have hereunto
set my hand this twenty fourth day of December AD, 1890. Signed

published as his last will by the said Daniel L. Richardson, in the
presence and in the presence of each other, have hereunto subscribed our
