ARTHUR FORSTER & HANNAH His Wife to MATTHEW KELLY & GEORGE KELLY
Dated 12 June 1775
This Indenture made the twelfth day of June Anno Domini one thousand seven hundred and seventy five. Between ARTHUR FORSTER and HANNAH FORSTER his wife of Cumberland County, Derry Township and Province of Pennsylvania of the one part, and MATTHEW KELLY of the Township, County, and Province aforesaid and GEORGE KELLY of Buckingham Township, and County of Bucks and Province aforesaid of the other part. Witnesseth that the said ARTHUR FORSTER and HANNAH his wife for and in consideration of the sum of seventy 5 Pounds lawful money of Pennsylvania to them the said ARTHUR and HANNAH well and truly in hand paid by the said MATTHEW and GEORGE at or before the ensealing and Delivery of these presents the Rect whereof them the said ARTHUR and HANNAH doth hereby acknowledge and thereof and of every part and parcel thereof doth acquit exonerate and discharge forever the said ARTHUR and HANNAH Heirs and Assigns by these presents hath Granted Bargained, Sold, Aliened, Released, Enfeoffed, and Confirmed and by these presents do Grant, Bargain, Sell, Alien, Release, Enfeoff and confirm unto the said MATTHEW and GEORGE heirs and assigns forever, all that certain piece or parcel of land situate lying and being in Derry Township in the County of Cumberland and Province of Pennsylvania all the following described mentioned and bounded Plantation and Tract of Land Situate and lying in manner and form following viz. Beginning at a Black (oak) joining land surveyed for the said ARTHUR FORSTER from thence North seventy four degrees East two hundred and thirty nine perches to a Spanish Oak from thence North sixty one East eighty four perches to a hickory, from thence North degrees thirty, West two hundred and sixty nine perches to a white oak, from thence forty degrees West one hundred and nine perches to a White Oak, from thence South twenty seven degrees, West one hundred and seventy four perches to a pine, from Thence South fifty four degrees, West twenty four perches to a hickory, from thence by land of the said ARTHUR FORSTER South eighty seven perches to the place of Beginning containing three hundred and twelve acres and four tenths of an acre with the usual allowance of six per cent for roads which tract of land was surveyed to ARTHUR BELL of Taxton Township Lancaster County and Province aforesaid in Pursuance of an order of Survey No. __ dated the 30th day of March 1768 which Tract of land the said ARTHUR BELL did convey and release unto the said ARTHUR FORSTER by an Instrument of Writing under his hand and seal dated the fourth day of April one thousand seven hundred and seventy four. Relation being thereunto had may more and fully appear. Together with all and singular the houses, out houses Edifices and Buildings thereon erected and built profits commodities, Advantages, Emoluments, hereditaments and appurtenances whatsoever to the same belonging or in any wise appertaining and the Reversion and Reversions, Remainders and remainders, Rents issues sand profits thereof, and also all the estate, right , title, interest use, trust, property, possession, claim and demand whatsoever of them the said ARTHUR and HANNAH of in or to the same or every or any part thereof and also all Deeds Evidence and Writings touching or concerning the same or any part thereof, and now in the custody or possession of them the said Arthur and Hannah or which he can or may come by without suit at Law or Equity. To have and to hold the said piece or parcel of land Hereditament and premises hereby granted with the Appurtenances unto the said MATTHEW and GEORGE KELLY heirs and assigns to the only proper use Benefit and behoof of them the said MATTHEW and GEORGE heirs and assigns forever under and subject to the Residue of Purchase money, interest and yearly Quit Rent now due and hereafter to become due for the same to the Chief Lord or Lords of the fee thereof. And the said ARTHUR and HANNAH FORSTER heirs, Executors, and administrators do covenant promise and grant to and with the said MATTHEW and GEORGE KELLY heirs and assigns that they the said ARTHUR and HANNAH FORSTER heirs and assigns and all and every other person and persons them or their heirs anything having or claiming in the said premises have granted or ment, mentioned or intended so to be or any part thereof by from or under him, them or any or either of them shall and will from time to time and at all times hereafter upon the reasonable request and at the proper costs and charges of him the said ARTHUR FORSTER heirs and assigns make, do and execute or cause and procure to be made done and executed all and every such further and other Lawful and reasonable Act and Acts thing and things Conveyances and assurances in the Law whatsoever for the further better more sure and perfect granting, conveying and assuring of all and singular the said premises with the appurtenances unto the said MATTHEW and GEORGE KELLY heirs and assigns forever as by them the said MATTHEW and GEORGE KELLY heirs or assigns or them or their Council Learned in the law shall be reasonably advised, devised and required And he the said ARTHUR and HANNAH FORSTER heirs the sd piece or parcel of land above described and premises unto the said MATTHEW and GEORGE KELLY heirs and assigns against them the said ARTHUR and HANNAH and their heirs and against all and every other person or persons whatsoever lawfully claiming said premises or any part thereof shall and will warrant and forever defend by these presents only the Chief Lords of the fee thereof Excepted. In witness whereof the said Parties to these presents have hereto interchangeably set their Hands and Seals the day and year first above Written.

Cumberland County SS: This twelfth day of June Anno Domini one thousand seven hundred and seventy five, Before me the subscriber one of his Majesties Justices of the Peace for the County aforesaid personally came the above named ARTHUR and HANNAH FORSTER and acknowledge the above Indenture to be their Act and Deed, and desired that the same might be Recorded as such. In Witness whereof I have hereunto set my hand and seal the day and year above written. Note the date being wrote upon a Razure before signed according to Agreement.
