Held Monday, 20 August 1877. The matter of the account of Jacob Shertzer, surviving executor of Christian Cassel.
The appointed Auditor is to distribute balance to the hands of Jacob Shertzer and among legatees. The executor and his attorney, J.W. Killinger met with the Judge on Thursday, 27 Sept 1877 at 10 o'clock AM. Meeting was continued to 12 Oct 1877. The executor & attorney received affidavits and distribution was to be equally divided among all the grandchildren, share & share alike, with any deceased grandchildren's children receiving the parent's share equally. There was $1110.00 to be divided from the estate of Christian Cassel.

In the Name of God Amen, I Henry Berry of Anville Township in the County of Lebanon and in the state of Pennsylvania being at present sick and weak of body but of sound and well disposing mind memory and understanding thanks be unto God for the same considering the mortality of my body and that it appointed for all men once to die therefore do hereby make and ordain this to be my last Will and Testament in the following manner to wit: First I recommend my soul to God who gave it and my body to the earth to be decently interred and as touching and concerning such worldly estate wherewith it has pleased God to bless me in this life I give and dispose of as is hereinafter mentioned to wit: It is may will and I do hereby order and direct that my beloved wife Marie Esther shall have a right to take house and keep such and so much of my household and kitchen goods, furniture beds and articles as she may chose to take and keep and my said wife Maria Esther shall also have use possess and enjoy my house and lot with the appurtenances wherein we now live situate in the Town of Anville in the Township of Anville and County of Lebanon aforesaid adjoining two streets and lot of Jacob Hoffman for and during her life.
Item; I give and desire unto John Berry and Henry Berry, children of John Berry deceased and to their heirs and offspring my tract or piece of land situate in Union County adjoining the several lands now or late of Merf Habenberger, Rusho Meyer and others containing about one hundred and seventy acres.
Item; I give and desire unto Christian Cassell intrust to and for the use and benefit of his son William Cassell to be applied to his support as hereafter mentioned my Small Piece or Parcel of Land with the appurtenances situate in Hanover Township in the County of Dauphin adjoining Lands of Mr. Shell, Robert Hill and others containing about five acres and the said Christian Cassell may either suffer and permit the said William Cassell to live on the said premises from time to time and at such times as he may deem expedient and to the use and benefit thereof for and towards his support or demise the source from time to time and apply the rent produce and profits there from arising for the purpose aforesaid. And at and immediately after my death of the said William Cassel, the said piece or parcel of land with the appurtenances shall belong to his children and I do give and desire the same unto them in fee simple as tenants in communion.
And it is may will and I do hereby order and direct that my lot or piece of ground with the appurtenances adjoining the several lots of Adam, Lebrich and William Shertzer and my moiety or half part of the lot or piece of ground with the appurtenances the other moiety being owned by Christian Cassel both situate in the Town and Township of Anville aforesaid shall severally by sold by my executor herein after named and appointed or the survivors or server of them at such time or times and for such manner of payments as they may deem most expedient.
And I do give and bequeath unto my said wife Maria Esther the one half part of the monies arising from the sales of the said lot or piece of ground...(unreadable le)... of the said lot or piece of ground and appurtenances ...(unreadable) ... directed to be sold as aforesaid and also the one half part of all money debts and money outstanding and owing to me and of all my other property not by me herein before otherwise disposed of . Item: I give bequeath unto my brother Peter Berry for his own use and benefit the sum of one hundred and fifty dollars. Item: I give and bequeath unto my sister Barbara now the wife of Christian Cassel the sum of one hundred and fifty dollars. Item: I give and bequeath unto my sister Margaret now the wife of John Rugest the sum of one hundred dollars to be paid to herself and for her separate use and benefit from time to time as may executors may think proper.
Item; I give and bequeath unto my stepsister Christiana twenty dollars and unto my stepsister Catherine twenty dollars. Item: i give and bequeath unto my brother Conrad Berry the sum of two hundred dollars to be paid and applied for his support from time to time as my executors may deem expedient. It is my will that the several specific legacies last mentioned shall be paid out of the other half past of the proceeds of my estate not given to my wife as herein before mentioned. And it is my will and I do hereby order and direct that the lot or piece of ground wherein we now live with the appurtenances shall be sold by my executors or the survivor or survivor of them after the death of my said wife in such manner of payment as them may deem most expedient and the one half part of the money arising from the said sale shall be given and paid over to such person or persons as my said wife in and by her last will and testament shall or may direct or appoint to have and receive the same in case she makes no will or testament then the same shall descent and be paid to her heirs or legal representatives according to law and the other half part arising from the sale aforesaid shall be divided and paid as follows: two hundred dollars thereof unto John Miller, son of Frederick Miller deceased; two hundred dollars thereof unto Catharine, the wife of Jacob Kittle; the further sum of two hundred dollars thereof unto John W. Killinger, son of John Killinger; the further sum of one hundred dollars thereof unto Magdalna Berry, the further sum of one hundred dollars thereof unto William Berry, two of children of Conrad Berry and the remainder thereof and of all my estate whatsoever and wheresoever the same may be and not by me herein before otherwise disposed of I give and bequeath unto the children of the said William Cassell to be equally divided between them. And I do hereby authorize and empower my executors and the survivor and survivor of theirs to make and execute deeds in fee simple to the purchasers of my houses, lots and premises here before directed to be sold and the devisers in fee simple for the lands and premises herein before to them devised. And lastly I do hereby nominate and appoint may said wife Maria Esther and my friends Christian Cassel and John Killinger executors of my Lat Will and Testament and I revoke and annul all aforesaid and other Wills and Testaments by me heretofore made and ratify and confirm this and no other to be my last Will and Testament. In witness where of I have hereunto set my hand and seal the sixth day of September in the year of our Lord, one thousand, eight hundred and twenty six.

In the name of God Amen This Fifteenth Day of July in the Year of our Lord one thousand Eight hundred and nine I Margarth Desh, of Bethel Township, in the County of Dauphin, and State of Pennsylvania Widow Being at present Old and Sickly and weak in Body but Nevertheless of Sound and Disposing mind and Memory and understanding Thanks be to God for the same calling unto Mind the Mortality of my Body and knowing that it is appointed For all Men once to die. Do make and Ordain this my Last Will and Testament
That is to say: Principally and first of All I Recommend my Immortal Soul into the Hands of Almighty God who gave it me and my body, I Recommend to the Earth to be Buried in a Decent and Christian like manner at the Discretion of my Hereafter Named Executor; and us Touching such worldly Estate wherewith it hath Pleased God to Bless me in the Life. I Give and dispose of the same in the following Manner and Form: Imprimis, this is my will and I Do hereby order in the first place that all my Just Debts and funeral expenses should be paid off out of my estate as soon as Conveniently may be by my Hereafter named Executors

Item it is my will that my House and Lot of Ground in Stumpstown, where (I at Present Live in) the said Township of Bethel and County aforesaid, Shall be sold on Public Vandue to the Higest Bidder and Best Price as may be gotten for the same, and I do hereby Impower My Executor or Executors or the Survivor of them, to Give, Sigh, Seal and Deliver a deed Sufficient Deed of Conveyance for the same to the Purchaser of the same and the money arissing out of my Real Estate Shall be likewise, Equally Divided unto the amongst all my above mentioned and Named Children Share and Share alike,
Item it is my will and I give and Bequeath unto my Daughter Barbara now the wife of Jacob Rudy the sum of Four Pounds Nine Shilings and four pence, farthing. Over and above her Equal Share with the Test of my other Children, which said sum of money belongs to her the said Barbara out of the Perssonal Estate of my Late Husband Philip Desh (and Father of the said Barbara) Deceased and Shall be paid to her by my Executor out of the first money arissing out of my Estate after my Decease, and it is Further my will that if any of my above named Children or their Representatives Shall Refuse or will not be Satisfied with their Respective Share so Bequeathed and ordered by me in the Proviss of this my Last Will and Testament by me made, all such Child or Children or Their proper Representative so refusing Shall Receive only Five Pounds in Stead of his or their Whole Equal share and no more of into, or out of all my Real and Perssonal Estate but shall Befor Ever Barred and Excluded of all and singular or every Part of parcel Except the within Five Pounds -- and no more anything herein Containing the Contrary hereof not withstanding And it is my will that all the Remainder of Real and Perssonall Estate which I shall Leave Behind me after my Decease, I give and Bequeath unto all my within mentioned Children John, Philip, Barbara, Elizabeth, anna Maria, Catharina, Jacob Cassel and to their Heirs and Assigns forever, Share and share alike (Except as as before Exceptet) (and ___ all those which will Refuse) and!

In the Name of God, Amen. I, George Fackler of Lower Paxton township, County of Dauphin, State of Pennsylvania, yeoman, considering the uncertainty of this mortal life and being of sound and perfect mind and memory, blessed be Almighty God for the same, do make and publish this to be my last will and testament in manner and form following, that is to say
First, I give and bequeath unto my beloved wife Susannah, two beds, bedding and bedsteads, her chest, spinning wheel and reel, such necessary households and kitchen furniture which shall appear for her own use, she shall have one cow at her own choice, she shall have eight cords of good fire wood yearly and every year or long as she remains my widow, that is to say four cords from the place whereon I now live and four cords from the place whereon John Beck now lives to be hawled to her house in seasonable times and the same shall be put up cut and split fit for stove use. She shall also have one ten plate stove and pipe and shall have all the linen in the house or at the weavers, she shall have one third part of the flax in the barn, she shall have one one third of the wool, she shall also receive of and my Executors herein after named yearly and every year during her natural life and as long as she remains my widow the sum of twenty five pounds specie for her support which my estate shall be liable to discharge and pay to her or her assigns during her natural life and her widowhood as aforesaid the said sum shall be paid to her yearly in quarterly payments, that is to say one fourth part thereof as soon the vendue of my moveables is held and from thence every three months following one fourth part of the aforesaid twenty five pounds. She shall have her choice either to live at the old mansion in a room by herself where she shall be entitled to cellar room to occupy part of the garden kitchen and stabling and shall have free egress and regress unmolested or to occupy and live in the house and lot at Harrisburg gratis during her natural life and widowhood as aforesaid. She shall have pasture for her cow and my son Abraham Fackler shall be obliged to bring her my said wife one good wagon load of good hay and my son-in-law John Beck shall be obliged to do the same each of them yearly and every year during the term aforesaid and after her decease the property left by her shall be divided among all my children equally share and share alike and the house and lot in Harrisburg aforesaid shall be sold by my Executors hereinafter named and they are hereby authorized or empowered to make a title in fee simple for the same and to divide the amount thereof to and among my children share and share alike.
Item: I give and devise unto my son John Fockler sixty acres of land adjoining Josiah Expey and Peter Bobb situate in Paxton township Dauphin County to him his heirs and assigns forever, as also twenty acres of land together with all and singular the buildings thereon erected and built, the same being part of the plantation whereon John Beck now dwells, to him his heirs and assigns forever and I do charge him the said John the sum of seven hundred and forty pounds for the same which shall be deducted out of his share from my estate, he the said John Fackler shall be obliged to bear an equitable and proportionable part for deeding the land whereof the twenty acres aforesaid is a part of the land as aforesaid. I also give and bequeath him the said John Facker one mare.
Item: I give and devise unto my daughter Barbara intermarried with John Beck all the residue of that plantation adjoining the Widow Whitely, Daniel Ream, Jacob Miller, Adam Smith and others in Paxton township as aforesaid supposing to be about one hundred and eighty acres to her her heirs and assigns forever and do charge her the said Barbara seven pounds ten shillings for each and every acre which might appear to be there which shall be deducted our of her share from my estate and the said John Beck shall be obliged to give bonds for the residue which will over run his equal share as an heir of my estate to my Executors herein after named and pay yearly and every year for such overplus fifty pounds into the hands of my Executors aforesaid.
Item: I give and devise unto my son Abraham Fackler all that plantation and tract of land whereon I now live supposed to be two hundred acres to him his heirs and assigns forever and I do charge him for each and every acre the sum of ten pounds, likewise I give and devise him the said Abraham Fackler a certain piece or parcel of land situate in Clarks Valley adjoining Hatz and Clark supposing to be twenty five acres to him his heirs and assigns forever for which he shall pay the sum of thirty pounds which all shall be deducted out of his share from my estate and shall pay yearly and every year fifty pounds and give bonds for the same to the other Executor for the overplus which shall be found to be above his share. I further give and bequeath unto him the said Abraham Fackler two mares which I now own and the one half of my stock of cattle of whatever nature or description it may be to his own use benefit and behoof.
Item: I give unto my daughter Sarah intermarried with John Crall twenty acres of land being part of my plantation whereon I now live to her her heirs and assigns forever and I do charge her the said Sarah ten pounds per acre which shall be deducted out of her share out and from my estate, my son Abraham Fackler shall be obliged to give them a deed for the same at any time when reasonable called upon.
Item: I give and devise unto my daughter Rachel all that certain piece or tract of land situate in Upper Paxton township adjoining land of Messersmith containing about one hundred and ninety seven acres to her her heirs and assigns forever. I do charge her for the same the sum of three hundred pounds which shall be deducted out of her share out and from my estate. I also give and bequeath unto her my said daughter Rachel one feather bedd and bedding and one cow and it is my desire that she shall remain in my house if she chooses as long as she remains single
Should any of my children be dissatisfied of the disposal of my real estate in the manner as I have prescribed I let them have their own choice either to take the land at the prizes I have thought to fix upon or let the same be sold either at private of publick sale and in that case I do hereby authorize and empower my Executors herein after named to sell and convey such tract or tracts of land to the best advantage they posslble can and to sign seal and deliver such conveyance or conveyances agreeably to law and the produce of such sale or sales shall be divided among all my children share and share alike. It is further my will and I do herby direct that as soon as possible after my decease my Executors shall make sale of my moveables except what I have bequeathed or disposed of before and the produce thereof shall be appropriated towards the discharging of my debts and if my personal property should not be sufficient to discharge the same then the first due sales or money coming in from my real estate shall be applied for the same before one of my children can receive part of their respective shares.
Item: I give and bequeath my two grandchildren, to wit George Fackler son of John Fackler and George Fackler son of Abraham Fackler the sum of one hundred pounds each which my Executors are hereby directed to detain out of my estate for them the said my two grandchildren and when each of them arrives at the age of fourteen years each of them shall be entitled to draw interest for the same from that time or the proper persons appointed for them may receive the same from my Executors or the money may remain in the hands of my Executors by securing the said one hundred pounds to each of them and it is my desire and my will that all my children shall e alike and receive equal shares out of my whole estate and be equally distributed among them and lastly I do hereby nominate constitute and appoint my son Abraham Fackler and John Crall my Executors if this my last will and testament hereby revoking all former wills by me made. It is therefore my will that the present George son of John Fackler shall be entitled to the same as his brother George would have been in case he was living. Finally it is my will that in case any dispute should arise between my heirs concerning the construction of this my last will the same may be decided without court according to the principles the great and good Washington has laid down by his last will. All my stock horses wagons ploughs harrows I give and bequeath unto my son Abraham.
