ADAM COOK Estate to DAVID GRIFFITH - Donated by Margaret Gagliardi
This Indenture made the twenty eight day of August in the year of our Lord one thousand seven hundred and eighty seven Between GEORGE COOK, ADAM COOK, and MICHAEL COOK of Franklin County and State of Pennsylvania of the one part and DAVID GRIFFITH of Brothers Valley Township Bedford County & state afforsaid of the other part. Witnesseth that the said GEORGE COOK, ADAM COOK and MICHAEL COOK for and in consideration of the sum of two hundred & thirty seven pounds ten shillings Specie to them in hand paid by the said DAVID GRIFFITH the receipt whereof is hereby acknowledged, hath granted, bargained, sold, aliened, and confirmed and by these presents doth grant, bargain, sell alien and confirm unto the said DAVID GRIFFITH his heirs and assigns forever a certain plantation or tract of Land Situate in Elklick township, formerly Brothers Valley Township Bedford County & State aforesaid which said tract of land a certain BENJAMIN BIGGS sold to ADAM COOK for one hundred & twenty five pounds which will appear by a bill of sale from said BIGGS to said COOK bearing date the 1st day of June in the year 1773 and Said ADAM COOK got a warrant for said tract of land bearing date in Philadelphia the 7th day of february in the year of our Lord 1776 which has been, or may be surveyed and whereas the said ADAM COOK now being deceased did appoint and ordain by his last will and testament the aforesaid GEORGE COOK, ADAM COOK & MICHAEL COOK executors of his last will and testament with full power and authority to sell and give as sufficient a deed for the above mentioned tract of land as he would do himself if he was living now this Indenture Witnesseth that the said GEORGE, ADAM, & MICHAEL COOK for and in consideration of the sum of two hundred and thirty seven pounds ten shillings aforesaid to them in hand paid by the aforesaid DAVID GRIFFITH, hath granted bargained & sold together with all and Singular the buildings, improvements, ways, woods, water courses, rights liberties, priviledges, hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and all the estate, right, title, interest, property, claim, and demand whatsoever in law or equity of them the said GEORGE, ADAM, & MICHAEL COOK, their heirs executors and administrators of in and to the said DAVID GRIFFITH his heirs assigns & administrators or assigns To have and to hold the aforesaid tract of land hereditaments and premises hereby granted or mentioned or intended so to be with their and every of their appurtenances unto the said DAVID GRIFFITH his heirs and assigns to the only proper use and behoof of the same DAVID GRIFFITH his heirs and assigns for ever and the said GEORGE, ADAM, & MICHAEL COOK, for themselves and their heirs the said tract of land and premises & every part thereof against them and their heirs and against all and every other person & persons whatsoever to the said DAVID GRIFFITH his heirs & assigns (the proprietors of the Commonwealth of Pennsylvania duly excepted shall and will warrant & forever defend by their presents. This Indenture Made the Thirth Day of April in the Year of our Lord Eighteen hundred and Eleven, Between GEORGE KOUGH and ELIZABETH his Wife of State of Maryland of the County of Allegany, Daughter of LUDWICK BARKLEY late Deceased, who is one of the Heirs and Representatives, of LUDWICH BARKLEY as aforesaid of the One part, and JOHN BARKLEY of Brothers Valley Township Somerset County and State of Pennsylvania of the other part. Witnesseth, that the said GEORGE KOUGH and ELIZABETH his Wife for & in Consideration of the Sum of One hundred Dollars hath this Day granted, bargained & sold unto JOHN BARLEY for and in the Consideration aforesaid, all their right, title, Claim, Interest & Demand in fee simple or otherwise in law or equity of in, to and out of a Certain Tract of land of Two hundred Acres be the same more or less which was formerly occupied by SUDWICK BARKLEY aforesaid, Situate in Somerset County, and all the premises with the appurtenances thereunto belonging or in any wise appertaining with all the moveable property whatsoever, To Have and to Hold the same unto the said JOHN BARKLEY his heirs & assigns for ever, and for no other use, Interest or purpose whatsoever, the same tact of land being still undivided between the Heirs and Representatives, of him the said LUDWICK BARKLEY deceased whatsoever, so that neither we the said GEORGE KOUGH and EWLISABETH his Wife nor any other person or persons whatsoever for us or in our Side any manner of Dower or action, right or title of Dower or other Interest, Claim or Demand whatsoever of in or to the said Messuages aforesaid Hereditaments and premises before mentioned or of or in any part or parcel thereof at any time hereafter shall or may have __ or prosecute against the said JOHN BARKLEY his heirs or assigns. This Indenture made this fourth day of march in the year of our Lord eighteen hundred and fifteen between JACOB KORN of Allegany County in the state of Maryland of the one part and DANIEL UHL of Somerset County in the Commonwealth of Pennsylvania of the other part doth witness, that the said JACOB KORN for and in consideration of the sum of one hundred & thirty dollars current money of the United States to him in hand paid by the said DANIEL UHL before the unsealing and delivery of these presents receipt whereof is hereby acknowledged by the said JACOB KORN, and from every part and parcel thereof doth hereby acquit, exonerate and discharge the said DANIEL UHL his heirs, executors, and administrators, he the said JACOB KORN hath granted, bargained, sold, aliened, enfeoffed, and confirmed, and by these presents doth grant, bargin, sell, alien, enfeoff, and confirm, unto the said DANIEL UHL his heirs and assigns, all that part of a tract or parcel of land lying and being in Southampton township Somerset County in Commonwealth aforesaid being part of a tract of land surveyed for a certain JOHN KENICK on the tenth day of October in the year of our Lord seventeen hundred and sixty seven, (lying on Jennings run, then in Cumberland County, but now in Somerset County) in pursuance of an order No 4320 dated the twenty second day of August in the year of our Lord seventeen hundred and sixty seven Beginning for said part at a hickory tree and two hickory saplings marked with six notches on each standing at a corner of JOHN KIMBERLYs land and running thence and bounding on HAYMANs and JACOB UHLs lands by an allowance of two and one half degrees for variation south two degrees and one half degrees east forty one perches to a hickory sapling marked with six notches thence having said lands west eighteen perches to a walnut post marked with six notches, south sixty degrees west twenty two perches to a post standing near a dogwood marked with six notches north seventy degrees west ninety two perches to a white oak tree marked with six notches, north ten degrees east sixteen perches to a white oak tree marked with six notches, standing on a line of the aforesaid JOHN KIMBERLYs land thence with said land north eighty seven degrees and one half degree east one hundred eighteen and a half perches to the place of beginning Containing twenty six acres and fifteen perches with the usual allowance of six per cent &c. Together with all and singular the buildings, improvements, woods, ways, waters, water courses, rights, liberties, privileges, hereditaments, and appurtenances whatsoever, thereunto belonging or in any wise appertaining, and the reversions, and remainders, rents, issues and profits thereof, and all the estate, right, title and interest whatsoever, of him the said JACOB KORN both at law and in equity, of in and to the aforesaid described part of the aforesaid tract of land or survey so as aforesaid mentioned, and premises, hereby granted bargained and sold, and every or any part and parcel thereof, To have and to hold the said part of the aforesaid tract of land or survey so as aforesaid described together with the buildings and appurtenances, and all and singular, other the premises hereby bargained and sold and every part and parcel thereof, with their and every of their appurtenances, unto the said DANIEL UHL his heirs and assigns, forever, and to and for no other use, intent or purpose whatsoever; and the said JACOB KORN for himself, his heirs, executors, and administrators doth hereby covenant, grant, promise and agree, to and with the said DANIEL UHL, his heirs, executors, administrators or assigns, that he the said JACOB KORN, and his heirs the said part of therefore said tract of land or survey and premises, hereby granted, bargained and sold, and every part and parcel thereof, with the appurtenances thereunto belonging, to him the said DANIEL UHL his heirs, and assigns against him the said JACOB KORN and his heirs, and against all and every person or persons, whatsoever claiming or to claim, any right title or interest in and to the same or any part thereof, shall and will hereafter warrant and forever, defend by these presents. Be it remembered that on this fourth day of march in the year of our Lord eighteen hundred and fifteen personally appears JACOB KORN of Allegany County, being the party Grantor above named, before us the Subscribers two of the Justices of the peace in and for the County aforesaid and acknowledges the within deed or instrument of writing to be his act and deed and the lands and premises therein mentioned, and hereby bargained and sold, to be the right and estate of the above named DANIEL UHL part grantee also therein named, his heirs and assigns, forever according to the purport, true intent and meaning of the said deed or instrument of writing, and the Acts of Assembly in such case made and provided, and now also at the same time personally appears CATHARINE KORN wife of the said JACOB KORN before us the Subscribers two of the Justices of the peace in and for the County aforesaid, and acknowledges the said deed or instrument of writing to be her act and deed, and the lands and premises, therein mentioned, to be the right and estate of the above mentioned DANIEL UHL his heirs and assigns forever - And the said CATHARINE KORN being by us examined apart from and out of the hearing of her husband whether she doth relinquish her right and claim of dower of in and to the lands and premises above mentioned, and acknowledges she doth the same willingly and freely, without being induced thereto by fear or threats of or ill usage by her husband, or fear of his displeasure, according to the acts of Assembly in such case made and provided. Survey either in law or equity as will appear by his deed of Conveyance from JOHN MIFFLIN Esq of the City of Philadelphia counsellor at law and CLEMENTINE his wife, and LEVY? PHILIPS and LEAAH his wife and KILEIH? COHEN executors of the last will and Testament of JOSPEH SIMONS State of the Borough of Lancaster in Pennsylvania Merchant deceased by their deed to him bearing date the seventh day of october in the year of our Lord eighteen hundred and twelve and wherever it does further appear that a part of the above described part of BRUNSWICK Survey sold and conveyed by the aforesaid JACOB KORN to the above mentioned DANIEL UHL is a part of the estate of the above mentioned JOHN T. MIFFLIN Esquire and CLEMENTINE his wife and LEVY PHILIPS and LEAH his wife and KILEIH? COHEN executors as aforesaid and that the only legal and equitable title of the following described part of said Survey is still vested in them and whereas the aforesaid JOHN F. MIFFLIN and CLEMENTIA his wife and LEVY PHILIPS and LEAH his wife and KILAH COHEN executors as aforesaid have appointed JOHN ANDERSON Esquire of the Borough of Bedford in Bedford County in Pennsylvania Merchant their lawful and only Attorney to sell transfer and convey the following described part of the aforesaid tract of land. Now this Indenture made this third day of March in the year of our Lord eighteen hundred and fourteen Between the aforesaid JOHN ANDERSON Attorney as aforesaid in behalf of the aforesaid JOHN F. MIFFLIN and CLEMENTINE his wife on their own proper account and LEVY PHILLIPS and LEAH his wife and KILAH: COHEN executors as aforesaid of the one part and the aforesaid DANIEL UHL of Southampton Township in the County of Somerset in the Commonwealth of Pennsylvania of the other part Witnesseth that the said JOHN ANDERSON for and in consideration of the sum of one dollar current money of the United States to him in hand paid by the said DANIEL UHL at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged by the said JOHN ANDERSON and from every part and parcel thereof doth hereby acquit & exonerate the said DANIEL UHL his heirs executors and administrators he the said JOHN ANDERSON hath given granted bargained and sold aliened released enfeoffed and confirmed and by these presents do according to the powers in him vested give grant bargain and sell alien release enfeoff and confirm unto the said DANIEL UHL and to his heirs and assigns a part of a certain tract or parcel of land situate in Southampton Township in the County of Somerset in pennsylvania aforesaid Beginning for and part at a hickory tree and two hickory saplings marked with six notches in each standing at a Corner of JOHN KIMBERLY's land and running thence by an allowance of two and an half degrees for variation south two degrees and an half degree east four perches to a black oak south seventy three degrees and an half degree west ninety one perches and an half perch to the fourth line of that part of said tract conveyed as aforesaid by JACOB KORN to the said KANEIL UHL and with the line thereof north twenty degrees west thirty one and a half perches to a white oak tree marked six notches a corner of HOY's? line, north ten degrees east sixteen perches to a white oak tree marked six notches on a line of KIMBERLYs land north eighty seven and half degrees east one hundred eighteen & a half perches to the beginning containing __ acres and seventy four perches and the allowance of Six per Cent &c [it being part of a tract of land Surveyed in the name of JOHN RUNICH and which the Commonwealth of Pennsylvania by letters patent being & to in or about the month of October one thousand seven hundred and ninety five duly written in the rolls office of Pennsylvania granted and confirmed unto the said JOHN F. MIFFLIN in fee and upon an amicable adjustment of a Contravercy at law, by articles bearing date the thirtieth of december eighteen hundred and two entered into between the said JOHN F. MIFFLIN and the said JOSEPH SIMONS filed in the Superior Court of Pennsylvania respecting the above described tract of Land among others it was agreed that the same should be sold under the direction of the said JOHN F. MIFFLIN and JOSEPH SIMONS and the neat proceeds equally divided between them and that the should both execute all necessary conveyances to make compleat titles to the purchasers thereof and it was therein further agreed that the said JOSEPH SIMONS and his heirs should be considered as holding the said land as tenants in Common with him the said JOHN F. MIFFLIN and his heirs upon the terms and conditions expressed in the said agreement and after making the said agreement the said JOSEPH SIMONS departed this life having first made and published his last will and Testament in writing and therein did order and direct that his executors should sell and dispose of all his real and personal estate whatsoever and wheresoever not therein otherwise directed and disposed of and in and by the said Will nominated and appointed the said LEVY PHILLIPS and LEAH his wife and KILAH? COHEN executors thereof who have taken upon themselves the __ of the executors of said will. Together with all and Singular the ways woods waters water courses rights liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in any wise appurtaining and the reversions and remainders rents issues and profits thereof and all the estate right title interest property claim and demand whatsoever as well of him the said JOHN F. MIFFLIN and CLEMENTIA his wife as that which was of him the said JOSEPH SIMONS at and immediately before his decease in law equity or otherwise howsoever of in and to the same To have and to hold the said described part of the aforesaid tract of land hereditaments and premises hereby granted and sold with the appurtenances unto the said DANIEL UHL his heirs and assigns to and for the only proper use and behoof of the said DANIEL UHL his heirs and assigns forever and the said JOHN ANDERSON in behalf of the said JOHN F. MIFFLIN and his heirs and also in behalf of LEVY PHILLIPS and LEAH his wife KILAH COHEN executors &c of the last will and testament of JOSEPH SIMONS aforesaid and his heirs the said described part of the said tract or parcel of land hereditaments and premises hereby granted with the appurtenances unto the said DANIEL UHL his heirs and assigns against him the said JOHN F. MIFFLIN and his heirs and also against them the said LEVY PHILLIPS and LEAH his wife and KILAH COHEN executors &c of JOSPEH SIMONS and his heirs and against all and every person or person whatsoever lawfully claiming or to claim by from or and at them or any of them shall and will warrant and forever defend by these presents. This Indenture, made the eight day of April in the year of our Lord one thousand eight hundred and twenty six Between JOHN KEMMARLE of Stark County, Green Township in the State of Ohio and SUSANAH his wife of the one part; and DANIEL UHL of Southampton Township in the County of Somerset & Commonwealth of Pennsylvania of the other part Witnesseth: That the said JOHN KEMMARLE and SUSANAH his wife for and in consideration of the sum of Nine Hundred Dollars lawful money of the United States to them in hand paid by the said DANIEL UHL at and before the ensealing and delivery hereof the Receipt whereof they do hereby acknowledge and thereof acquit and forever discharge the said DANIEL UHL his heirs executors and administrators, by these presents Have granted, bargained, sold, aliened, enfeoffed, released and confirmed, and by these presents Do grant, bargain, sell, alien, enfeoff, release and Confirm unto the said DANIEL UHL his heirs and assigns, all that certain tract or piece of Land situate in Southampton Township and county of Somerset aforesaid in the Commonwealth of Pennsylvania now in the possession of the said DANIEL UHL Beginning at a hickory marked six notches a corner of JACOB WITT's land thence South seventy seven degrees west sixty six and half perches to the line of ISAAC HARDIN's land two perches East of his black oak Corner, thence South four degrees West thirty four perches to a post, thence South fifty four degrees East nine perches to a small birch on a Rock, thence South eighty four degrees west fourteen perches to a sugar tree thence South fifteen degrees East thirty three perches to a post thence East one hundred and seventy perches to a black oak, thence North two degrees and an half west one hundred and twenty one perches to a post, thence North forty three and an half degrees West thirty one perches to a black oak West two perches to a post, thence South fifty two degrees West ninety six perches to the place of Beginning Containing Ninety Four acres and a half and allowance of six per cent for Roads &c {The same being part of a tract of Land which was originally resurveyed upon application entered in the land office in the name of PATRICK BECK? No. 4318? Dated the twenty second day of August one thousand seven hundred and sixty seven on which was resurveyed the eleventh day of October 1767 three hundred and twenty two acres of Land of which the hereby granted is a part as aforesaid and the whole of which said Three hundred and twenty acres by sundry means conveyances and apurances became vested in a certain JOHN F. MILLFIN & whom the said tract of Land was confirmed by the Commonwealth of Pennsylvania by Patent bearing date the seventeenth day of October one thousand seven hundred and ninety five Recorded in the Rolls office for the Commonwealth of Pennsylvania in Patent Book No. 26, Page 308 and the said JOHN F. MIFFLIN by his Attorney JOHN ANDERSON by his Deed Pole bearing date the fourth day of September in the year of our Lord one thousand eight hundred and thirteen and Recorded at Somerset in the Office for Recording of Deeds &c in and for the County of Somerset in Record Book Vol nine page 259? &c conveyed the same part hereby granted to JOHN KEMMARLE the party grantor hereto} Together with all and singular the buildings, improvements, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining, and the reversions and remainders, rents, issues and profits thereof; And also all the estate, right, title, interest, property, claim and demand whatsoever of them the said JOHN KEMMARLE & SUSANAH his wife in law or equity or otherwise howsoever, of in, to, or act of the same. To Have and To Hold the said tract or piece of land hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said DANIEL UHL his heirs or assigns, to the only proper use and behoof of the said DANIEL UHL his heirs and assigns forever. This Indenture made the first day of April in the year of our Lord Eighteen hundred and thirty four between GEORGE LONG of Southampton Township Somerset County and State of Pennsylvania yeoman of this one part and DANIEL UHL of the same place of the other part whereas the Commonwealth of Pennsylvania by their two patents each whereof dated 30 day of June 1808 and one of them granted to JOHN RHOADS the other to ELIZABETH McDERMITT relation being had to the Rolls office of the Said Commonwealth in patent book No. 63 pages 236 & 237 will more fully appear, And Whereas JOHN Wells Esqr by his deed dated 29th day of June A.D. 1813 did grant and Convey all the Two above mentioned Tracts of land unto the Said GEORGE LONG SENR. Sir if Mother wishes to keep the things that she had when last married then I will agree for my part that we the heirs here that is myself, JACOB & SAMUEL bind ourselves to pay to you the appraised price of all the articles she brought to father and let her also have a Cow in place of the one she had that is she shall have and keep every thing of whatsoever nature and kind the same may be that she have when she Married father provided it is there but we will not be bound to give or Deliver any article or thing that was broke lost worn out or old but all yet there and one cow her choice in place of the one she had and Shal moreover have the third part of fathers remaining Personal property whoall is settled up that is the one third part of the personal Estate when the Debts and all fees and charges are paid and deducted therefrom ready for distribution provided She Release her dower or thirds in fathers land if she signs the Release for the said land Before a Justice of the peace then we the said heirs will pay you all the said articles at the appraisement price and you can then give them to her on the Spot and if Sally's heirs do not agree to it then we must pay them their share and keep it out of their part of said dower. This Indenture made the first day of November in the year of Our Lord One thousand Eight hundred and forty seven between GEROGE G. WALKER and SAMUEL GAUMER Assignees legally nominated and appointed of GEORGE COOK esquire On insolvent debter all of Southampton Township in the County of Somerset and Commonwealth of Pennsylvania of the one part, and JOHN R. BRINHAM of the town of Harrisonville (Alias Wellersburg) in the township of Southampton aforesaid Merchant of the other part. Witnesseth that whereas the Said GEORGE COOK Esq. Being lawfully Seized in his demise as of fee among Other things Is of and in the undivided half of fields or pieces of Ground Situate in the town of Harrisonville in the township of Southampton in the County of Somerset aforesaid lying and being on the South east side of the public road leading past the ___ yard owned and occupied by JEREMIAH WIEGART and opposite said property and frontage on Said road being each (lot) Sixty Six feet in front and Commanding at a post at the corner on the said road at lot numbers ten and __ South fourteen and a half degrees west two hundred and thirty one feet to a post in the ___ of Said lot Number two east of Said lot being of the Same depth and Containing the same quantity of ___ and adjoining each ___ and Number two, three, four, five and six having been Surveyed off a tract of land conveyed by GEORGE WELLER, and wife by and dated the tenth day of November 1838 to JOSHUA F. COX Esquire who by deed dated 19th October 1841 Conveyed the said five lots above described to JOHN R. BRINHAM and GEORGE COOK Esquire having made and executed a voluntary assignment of his Estate dated the sixth day of September in the year of our Lord One thousand eight hundred and forty four to the said GEORGE G. WALKER and SAMUEL GAUMER in trust for the use of his Creditors. And the said GEORGE COOK having complied with all the requisitions of the Acts of the General Assembly in such case provided as by the ___ And proceedings of the Court of Common Please of Somerset County will more fully and at large appear to forever thereto being had. Now this Indenture Witnesseth that the said GEORGE G. WALKER and SAMUEL GAUMER (having first Given bond with Security for the faithful performance of this trust) for and in consideration of the sum of One hundred and twenty dollars Whereas the said, GEORGE G. WALKER and SAMUEL GAUMER in hand paid by the said JOHN R. BRINHAM at and before the ensealing and delivery hereof the receipt Whereof they do truly Acknowledge thereof acquit and forever discharge the said JOHN R. BRINHAM his heirs Executors and Administrators by these presents have Granted bargained sold released and confirmed and by these presents (by virtue of the ___ ___) _________________________________ Act or General Assembly in such case provided I do grant bargain and sell, And sell release and confirm unto the said JOHN R. BRINHAM his heirs and assigns all the interest rights and titles of the said GEORGE COOK Esquire to the above mentioned and described five lots of Ground. Together with all and Singular the rights _____ privileges hereditaments and Appurtenances Whatsoever ____ belonging is in Any Wise Appertaining And the revisions and remainders, rents, issues and ____ and all the Estate, right, title, interest, property, claim and demand whatsoever of the said GEORGE COOK Esquire of in to and of the Same. To have and to hold the said five lots or pieces of Ground hereditaments and premises hereby Granted or mentioned or intended So to be with the appurtenances and the said JOHN R. BRINHAM his heirs and assigns to the only proper use and behoof of the said JOHN R. BRINHAM his heirs And assigns forever for such ___ and under Such Condition as he the said GEORGE COOK Esqr had and held the Same immediately before executing said Assignment to Said GEORGE G. This Indenture made the twenty eight day of April in the year of our Lord one thousand eight hundred and fifty one Between GEORGE G. WALKER & SAMUEL GANNIER assignees legally nominated and appointed by GEORGE COOK Esqr. insolvent debtor all of Southampton Township in the County of Somerset and Commonwealth of Pennsylvania of the one part and JACOB COOK of the Southampton Township, county & State of aforesaid of the other part. Witnesseth that whereas the said GEORGE COOK Esqr. being lawfully seized in his demise as of for, among other things of and in three lots of ground situate in Southampton Township, County of Somerset aforesaid lying and being on the North side of high street each of said three lots of ground fronting on said street sixty six feet and entered north to land of JOSHUA F. COX's heirs each one hundred and sixty five feet and numbered in the general plan of said Town twenty seven, twenty eight & twenty nine bound on the east by lot of JOHN D. BRINKHAM, Containing in all about three quarters of an acre, and lying north of the Wellersburg & west newton plank road said lots being surveyed of a track of land conveyed by GEORGE WELLER & wife to J. F. COX by deed dated the tenth day of November 1838 and the said three lots of ground became vested in GEORGE COOK Esqr by deed of Conveyance dated nineteenth day of July 1843 executed by JOSHUA F. COX & wife. And GEORGE COOK esqr having made a voluntary assignment of his estate of the said GEORGE G. WALKER and SAMUEL GAUMER for the use of his creditors dated sixth day of September 1844, And the said GEORGE COOK Esqr having complied with all the requisitions of the act of general assembly in such case provided as by the records and proceedings of the Court of Common Pleas of Somerset County will more fully and at large appear reference thereunto being had. Now this Indenture Witnesseth that the said GEORGE G. WALKER & SAMUEL GAUMER having first given bond with seventy for the fathful performance of their trust according to law in such case made and provided, whereas in pursuance of said trust to them the said Assignees Committed they first having given public notice and on the premises on the 9th day of December 1844 exposed the said three lots of ground to sale and sold the said lots of ground to said JACOB COOK for an at the sum of ninety dollars & fifty cts. He being the highest & best bidder and whereas the purchase money to them the said GEORGE WALKER & SAMUEL SRUMER in hand paid by the said JACOB COOK at and before the sealing and delivery of these presents, the receipt whereof they do hereby acknowledge and thereof acquit and forever discharge the said JACOB COOK his heirs executors and administrators by these presents, have granted bargained sold released and confirmed and by these presents and by ___ of the power and authorities to them given by the act of assembly in such case provided, do grant, bargain , sell, release and confirm unto the said JACOB COOK his heirs and assigns, all the interest of the said GEORGE COOK Esqr in the above mentioned and described three lots of ground Together with all and singular the buildings waters water courses, rights, liberties, privileges hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions, remainders, rents issues and profits thereof, and all the estate right title interest property claim, and demand whatsoever of the said GEORGE COOK to of in or out of the same. To have and to hold the said three lots of ground hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said JACOB COOK his heirs nad assigns to the only proper use and behoof of the said JACOB COOK his heirs and assigns to the only proper use and behoof of the said JACOB COOK his, heirs, for estate and under such condition as he the said GEORGE COOK Esqr. had and held the same before and at the assignment made to the said GEORGE G.
