To the Honorable JAMES A. HUNTER Judge of the Orphans Court of Westmoreland County.

The petition of LEVI FOX, JACOB C. KEPPLE and E. C. FOX respectfully represents that WILLIAM BECK in his lifetime became seized in his demise as of for a certain tract of land situate in Hempfield Township said County containing about one hundred and sixty eight acres. That after his death under proceedings in partition at No 4 August Term 1851 in this court the same was taken at the valuation and appraisement by CATHARINE one of his daughter who was married to DAVID GROSS. That by sundry deeds and conveyances the said tract of land has become vested in your petitioners and that they are now the owners thereof in the following proportioned to wit LEVI FOX 90 acres and 40 perches, JACOB C. KEPPLE 66 acres and 102 perches and E. C. FOX 11 acres and 18 perches. That the said tract of land was charged with a recognizance in favor of the widow ESTHER BECK of ten hundred and forty three and 42/100 dollars of which the interest was payable to her during her life and at her death the principal was to be paid to the heirs of the said WILLIAM BECK decd or their legal representatives. That the interest has been paid in full up to the date of her death which occurred a short time ago. That your petitioners have also paid two of the heirs of said WILLIAM BECK in full of their share in the principal of the said widows recognizance as appears by their receipts on the same and that there is still due on said recognizance the sum of Six Hundred and Twenty six and 06/100 dollars which is payable to ELIZ. HARROLD, MICHAEL BECK and CATHARINE GROSS or their legal representatives.

They therefore pray your Honor for lean to pay the Balance of said principal sum into Court that it may be paid out by decree of Court and said recognizance satisfied and discharged &c.

And now to wit 22 Nov 1851 on motion of Cook & Turney Inquisition confirmed Rule on their Heirs to appear at next term and accept or refuse the Real Estate at the valuation per Curiam - 18th Nov 1851

And now to wit Feb 17, 1852 on proof of the service of the rule having been made on the heirs to appear at this Term and accept or refuse the real estate at the valuation MRS. CATHARINE GROSS formerly CATHARINE BECK the second daughter appeared in Court and elects to take the real estate appraised the other heirs viz MICHAEL BECK, WM BECK, ELIZABETH HARROLD and SUSANNAH COPE formerly SUSANNAH BECK intermarried with JOSEPH COPE not appearing and being called in open court it is therefore adjudged to her viz 168 acres of land strict measure as in diagram annexed to the Inquisition. It is further ordered that the said CATHERINE GROSS entered into are recongnizance to pay the widow EASTER BECK the interest on the one third of the appraised value thereof annually during her life after deducting and at her death to pay the same to the other heirs according to their respective shares or interest. And it is also ordered that she enter into recognizance to the other heirs above named to pay them their several shares according to their several Interests in the Two thirds after deducting costs in one year with interest. CATHARINE (x) GROSS, SAMUEL DAVIDSON, and ABRAHAM LONG Held to court in the sum of $2086.84 Conditioned that CATHARINE GROSS pay or cause to be paid unto EASTER BECK the widow of WM BECK dec'd the interest on the sum of $1049.49. Each and every year during her natural life and at her death pay or cause to be paid unto the heirs of said dec'd their respective shares of said third and also held to ELIZABETH HARROLD, SUSANNAH COPE, WILLIAM BECK and MICHAEL BECK each in the sum of $837.74 Conditioned the said CATHARINE GROSS pay or cause to be paid in twelve months from this date to each of said Heirs the sum of $417.37 with interest. August 15, 1883 I do hereby acknowledge to have received from LEVI FOX, E. C. FOX, and JACOB KEPPLE the sum of two hundred and eight 68/100 dollars from LEVI FOX $112.11 JACOB KEPPLE $82.77 E. C. In the name of God, Amen. I WILLIAM BECK of the Borough of Youngwood in the County of Westmoreland and State of Pennsylvania Being weak of body but of sound and disposing mind and memory do make and declare this to be my last Will and Testament in manner following. That is to say I order that all my just debts, funeral expenses, and the charges of proving this my will be in the first place fully paid and satisfied, and after the payment thereof I dispose of my estate as follows, The share of stock in the McKinley Mining and Development Company of the Teritory of Arizona I bequeath as follows: Eighty (80) shares to my Grandson Frank Beiter, and sixty (60) shares to each of the following Grand children namely, MARY BECK, FRANCIS BECK, RAYMOND BECK, IRENE BECK, MORRIS BECK, LUELLA BECK, CLARENCE BECK, JOHN BECK, ALICE BECK, JESSE BECK, JOSEPHINE BEITER, OTTO BEITER, ELIZABETH BEITER, GEORGIA GEISEL, AND EDWARD GEISEL. I order that as soon as convenient after my death my executors hereinafter named shall sell my farm situate in Hempfield Township containing 86 acres more or less, and all other property "not herein disposed of" That I may have at the time of my death for the best price that can be obtained. I give and bequeath to my wife MARY ANN BECK in place of Dower My House and Lot situate on South forth street in the Borough of Youngwood Being Lot No. 100, fronting 50 ft on fourth Street and extending back 100 Ft to an alley and all my household goods and furniture and also Twenty five Hundred ($2500.00) dollars in money. I give and bequeath to my Grandson FRANK BEITER the sum of fifty ($50) dollar. I give and bequeath to my Grand daughter JOSEPHINE BEITER the sum of fifty (50) dollars. I give and bequeath to my Grandsons GEORGE BECK and my Granddaughter CORETTA BECK children of my son MELVIN P. BECK Dec'd the sum of (1) dollar each. The residue and remainder of my estate I give and bequeath to my children JOHN M. BECK, of Scotdale, Pa, ALFRED W. BECK of Salt Lake City, Utah, HARRY L. BECK of Youngwood Pa, ETTA BEITER of Manor Pa, ELIZABETH MALEY of Greensburg, Pa and FLORA GEISEL of Greensburg, PA share and share alike. I do hereby nominate, constitute and appoint my wife MARY ANN BECK and HUGH HENDERSON of Youngwood, Pa Executors of this my will hereby revoking and making void all former and other wills by me at any time heretofore made and declare, this to be my last will and testament, In Witness Whereof I the said testator WILLIAM BECK have to this my last will and testament set my hand and seal this 28th day of November A. I WILLIAM K. FINDLEY of Scottdale in the County of Westmoreland and State of Penna being of sound mind and memory do make publish and declare this to be my last will and testament to wit:

First - all my just debts and funeral expenses shall be first fully paid. Second - I give devise and bequeath all the rest residue and remainder of my estate both real and personal to my beloved wife LENA FINDLEY to have to hold to her my said wife and to her heirs and assigns forever.

Third - I nominate and appoint my said wife LENA FINDLEY to be the executor of this my last will and testament hereby revoking all former wills made by me. In witness whereof I have hereunto set my hand and seal this 6 day of February A.D. 1897.

LAST WILL AND TESTAMENT

I, ELIZABETH FINELY of Scottdale Boro, County of Westmoreland and State of Penna being of sound mind memory, do make, publish and declare this to be my LAST WILL AND TESTAMENT, in manner and form following, hereby revoking any will or wills heretofore made by me;

First: I direct all my just debts and funeral expenses be fully paid and satisfied, as soon as conveniently may be, after my decease.

Second I give all my estate to my niece, MRS. MARGRET DICKERHOFF, both personal, real, or mixed, and that the said MARGRET DICKERHOFF is to pay all Dr. bills and funeral expenses and erect a head stone for me, at cemetery.

And I do hereby make, constitute and appoint MRS. MARGRET DICKERHOFF to be the Executor of this my Last Will and Testament, and the said MRS. MARGRET DICKERHOFF is to serve without bond.

Before the Register of Westmoreland County personally appeared Margaret Dickerhoff, who being sworn, says that she is over twenty-one years of age and that she is the executrix appointed in the last will and testament of Elizabeth Finley, deceased, dated 11 Feb, 1922; that said testatrix, being at the time a resident of Scottdale Boro, Westmoreland County, and a citizen of Pennsylvania, died at Scottdale Boro on 11 Feb, A.D. 1922, at 4:20 P.M. possessed of personal estate to the value of $1200.00 that since the execution of the will offered for probate the said testatrix has not married and no child has been born to said testatrix that deponent (whose P. O. address is 201 Homestead Ave., Scottdale, PA, is a resident of Pennsylvania, and respectfully petitions the Register to admit said will to probate and to grant letters testamentary thereon to here.

Inventory and Appraisement of the goods, chattels, rights and credits which were of Elizabeth Finley late of Scottdale Borough, Westmoreland County, Pa., deceased. Westmoreland County, ss: W. M. Morrow duly being sworn according to law, depose and say that they well and truly and without prejudice or partiality will value and appraise the goods and chattels, rights, credits and effects of the said Elizabeth Finely deceased, and in all respects performed their duty as appraisers to the best of their skill and judgement. Commonwealth of Pennsylvania, County of Westmoreland, SS: I, Edward A. Cremer, Register for the Probate of Wills, etc., in and for said County and State, hereby do certify that Elizabeth Finely, late of Scottdale Borough, died on the 11th day of February, 1922, testate, first having made her last will and testament wherein she bequeathed her entire estate to Margaret Dickerhoff, a niece, and possessed of personal estate of the value of $1148.46, being the amount of a deposit in the First National Bank, Scottdale, Pa., $911.59, Policy of the Prudential Life Insurance Company of America, $211.87, and Household effects, etc., $25.00, as shown by the inventory and appraisement filed in my office, but not seized of any real estate; that the debts and expenses of administration of the decedent are as follows:

William Ferguson, Funeral expenses - $356.60

Elmer Morrow, services - $5.00

Byron Kelly, Supt., grave - $10.00
