Know all men by these presents that whereas Willam McKeen and John McKeen of the County of York and state of Pennsylvania are seized in fee of and in all that Lott of ground lying and situate in the town of Martinsburg and state of Virginia known and distinguished by No. 97 and the boundaries as in the Deed more fully appear know ye that we the said William and John McKeen have constituted and appointed....make and constitute John B. Tilden of the town of Martinsburg County of Berkeley and State of Virginia our true and lawful attorney for us and in our names to sell grant and convey the aforesaid Lott of ground, the same absolutely in fee simple for such price or sum of money and to such person or persons as he shall think fit and convenient and also for us and in our names to sell execute and deliver such deeds conveyances bargain and sales for the absolute sale and disposal thereof or any part thereof.

Articles of Agreement Between JOHN FRANCKEBERGER and ANDREW FREDRICK

Articles of Agreement made the twenty fourth day of July one thousand seven hundred & Sixty two Between JOHN FRANCKEBERGER of the Township of Paradise & County of York Province of Pennsylvania Yeoman of the one part, And ANDREW FREDRICK of the same Township County & Province Yeoman of the other part. Wittneseth That he the sd JOHN FRANCKEBERGER is to lay out of his owne Tract of Land, Adjoyding the sd ANDREW FREDRICKS Lands, Two ackers of Land as Convenance as can be made & for the same he the sd ANDREW FREDRICK is to give grand & line out of his Survay Two Ackers for the above mentioned two Ackers and two Ackers more adjoinding the same, which in all makes foure Ackers, which sd foure ackers Land shall be for a Lutheran Congregation to build a Church on, and the sd Congregation shall choose two or three Persons for to tack out a Warrant for the sd Congregation of the Honorable the Proprietor and to obtain a Patend for the sd foure Ackers for the use of the sd Congregation to Build a Church or any other houses as the ___ or the sd Congregation shall at any time agree by them there Heirs or assigns or followers of them the sd Lutheran Congregation and he the sd JOHN FRANCKEBERGER his Heirs Exectors Admrs or Asigns for the above mentioned Two Ackers of his own land to be lead for the sd ANDREW FREDRICK his Heirs or assigns, and as Soon as his the sd FRANKEBERGER his Heirs or Asigns shall obtain a Patend for his own Track he or they at the Cost of ANDREW FREDRICK his Heirs or Asigns deliver a Deed of Conveance to the sd ANDREW FREDRICK his Heirs or Asigns, he or they Paying the Quit Rent for the Two Ackers of Land which shal come due after these date and for the time to Com forever if damented of them the sd ANDREW FREDRICK his heirs Exect'r or Asigns. And for the transferance of all and singular the Covenants & Agremants aforsd the sd JOHN FRANCKEBERGER & ANDREW FREDRICK do bind themselves their Heirs Exect'rs Admrs or Asign firmly by these presents. Before me WILLIAM SCOTT Esquire one of the Judges of the Court of Common pleas in and for said County Personally appeared VALENTINE BERGHEIMER one of the Subscribing Witnesses to the foregoing Instrument of Writing and on his Solemn Oath taken according to Law, doth say that he did see the aforenamed. ANDREW FREDRICK make his mark unto & Seal Sign and as his Act and Deed deliver the foregoing Instrument of Writing that he made his mark thereto as Witnes in the presence of the said ANDREW FREDRICK and that he did also see MATTHEAS BEADLEY make his mark thereto as a Witnes.
