WILL OF TIMOTHY DARGAN
(I) [CAP:]In the name of God[:CAP] Amen I
Timothy Dargan of South Carolina Berkley county, being very sick and
Weak but in perfect Mind and Memory, thanks be given unto God;
calling unto Mind the Mortality of my Body, and knowing that it is
appointed for all Men Once to Die, do make and Ordain this my Last
Will & Testament That is to say, Principally and first of all, I
give and recommend my soul into the hand of Almighty God that gave
it, and my Body I recommend to the Earth, to be buried in decent
Christian Burial at the discretion of my Exors, nothing doubting but
at the general Resurrection I shall receive the same again by the
Might Power of God. And as touching such Worldly Estate
wherewith it hath pleased God to blefs me in this Life, I give
demise and Dispose of the same in the following manner and
form. (That is to say) After my just Debts and funeral Charges
is paid – Item I give and bequeath to Catharine my beloved Wife
during hr Life, all and singular my Lands Mefsauges & Tenements
together with all my household Goods, Debts and moveable Effects by
her feely to be pofsefsed and enjoyed and after her Death to be
disposed of in the following manner and form. ITEM
first, I give and bequeath to Timothy Dargan my Son this my dwelling
place with the said Tract of Land containing five hundred Acres with
all the Appurtenances thereunto belonging to him and his heirs for
ever lawfully begotten of his Body. ITEM I give and bequeath
to my Son William Dargan part of the Tract of Land formerly
belonging unto Edward Berwick containing three hundred Acres more or
lefs lying on the South side of the Branch, which emptys into the
Hornit and extends to the Lime kill up to the Rode, to him and his
heirs for ever lawfully begotten of his Body. ITEM I
give and bequeath unto my fon [son] Jeremiah Dargan the remainder
part of the Tract of Land formerly belonging to Edward Berwick, with
the hundred Acres which I surveyed adjoining, the said Land to him
and his heirs for ever lawfully begotten of his Body.
ITEM I give and bequeath to my Daughter Catharine Strother one
Negro Girl named Hannah to her & her heirs forever lawfully
begotten of her Body. Item I give and bequeath unto my
Daughter Elizabeth Dargan one Negro Girl named Rose to her & her
heirs for ever lawfully begotten of her body. ITEM I
give and bequeath unto my Son John Dargan One Negro Boymed Harry to
him and his Heirs forever lawfully begotten of his body.
ITEM I give and bequeath to my Grandson Charles Rufsell and my
Grand Daughter Mary Rufsel one Negro Girl named Mimmey to them or
either of them or their heirs forever lawfully begotten of their
Bodies, to be equally divide between the said Charles & Mary
Rufsell. ITEM I give and bequeath unto Catharine
Strother Elizabeth Dargan and Jeremiah Dargan each & every of
them one Feather Bed & Furniture and to my son Timothy Dargan I
give and bequeath two Feather Beds and Furniture Furniture to them
and their Heirs. ITEM I give and bequeath to my Son
Timothy Dargan, my riding Horse and to my Son Jeremiah Dargan, I
bequeath a New Suit of my Wearing Cloaths. ITEM my Will
is that the Remainder part of my Estate be equally divided between
the persons hereafter mentioned that is my Sons John Dargan, Timothy
Dargan, Jeremiah Dargan & my Daughters Catharien Strother,
Elizabeth Dargan & Dorcas Milner, Only the said Dorcas
Milner’s part shall be at the Disposal of my son Timothy Dargan, to
be converted to the Use of her and her heirs forever lawfully
begotten of her Body, And that her husband Benjamin Milner shall
have nothing to do with her part of my Estate on any pretence
whatever. And if my fon [son] William Dargan and my Son in Law
Charles Rufsell do make due payt. of the Sum of Money which I stand
bound for them on Account of Slaves bought off them, on or before
the first Day of January next after the date hereof. Then my
Will is that my son William Dargan shall draw an equal part of the
said Remainder of my Estate, to the use of him and his heirs forever
lawfully begotten of Body, and also my Grandson & Daughter
Charles and Mary Rufsell, shall draw likewise one part equal with
the above mentioned, John Dargan, Timothy Dargan, Jeremiah and
Elizabeth Dargan, Catharine Strother & Dorcas Milner of the said
Remainder of my Estate. And the said part to be equally
divided between the said Charles and Mary Rufsell to the use of them
or either of them & their heirs forever lawfully begotten of
their Bodies. And if the above mentioned William Dargan and
Charles Rufsell do not make such payment as aforesaid, then the
above mentioned Sum of money shall be William Dargans and Charles
& Mary Rufsell’s full part of the said Remainder of my
Estate. ITEM my Will is, that if any of the above named
persons should die without issue lawfully begotten of their bodies,
that their part of my Estate shall be equally divided between the
surviving parties before named. ITEM I likewise
Constitute make and Ordain my beloved Wife Catharine my Executrix
with my Son Timothy Dargan Executor of that my Last Will and
Testament, and do hereby utterly disallow revoke and disannul all
and every other former Testaments, Wills, Legacies Bequests and
Exors by me in any wise before named willed and bequeathed ratifying
and Confirming this and no other to be my last Will &
Testament IN WITNEFS whereof I have hereunto set my hand and
Seal this Eight Day of March in the Year of our Lord one thousand
seven hundred & sixty one Timothy Dargan (LS) Signed sealed published pronounced
and declared by the said Timothy Dargan as his Last Will
and Testament in the presence of Us who in his presence &
in the presence of each other have hereunto subscribed
our Names I, CLARENCE R. LUNZ, Judge of Probate
Court of Charleston County, and State of South Carolina , do hereby
certify the foregoing to be a true and correct copy of the last Will
and Testament of
Timothy Dargan
late of said County and State, deceased, admitted to Probate on the
5th day of November A.D. 1762 and of record in said Court.
