In the name of God Amen; of
the said I Joseph Pitts of the State of South Carolina and District of
Newberry; being in perfect health of body and in sound mind and memory
calling unto mind the mortality of my body and knowing that it is
appointed unto all men once to die, do make and ordain this my last will
and testament in manner following.
Viz, first my will is that my
just debts and funeral charges be first paid out of my estate, --Item I
give to my beloved wife Ann Pitts the remainder of my estate both personal
and real during her natural life or widowhood; provided she marries I give
to her an equal part with my children.
Viz, first I give to my
eldest son Amasa Pitts one tract of land containing ninety acres more or
lefs lying and being on the waters of Sandy Run conveyed to me by Henry
Pitts and one Negro boy named David,
Item I give to my eldest
daughter Nancy Akin five shillings to be raised and levied out of my
estate,
Item I give to my daughter Hannah Anderson five shillings
to be raised and levied out of my estate.
Item. I give to my son
Asa Pitts one negro boy named Harry and two hundred and fifty dollars in
cash to be raised out of my estate unlefs I should purchase for him a
tract of land previous to my death in that case he is not to have the
above named sum of two hundred and fifty dollars
--- Item I give
to my son Joseph Pitts the plantation or tract of land whereon I now live
containing one hundred and forty one and one third acres more or lefs and
one female salve named Beck with her infant child which she now has named
Sook and also all her future increase.
Item I give to my youngest
daughter Cealy Pitts one negro girl named Nance, one sorrel horse called
Match, one cloak and one side saddle, of the best quality also one negro
boy named Tone. Item I give to my grand daughter Ann Akin the daughter of
my eldest daughter Nancy Akin two hundred dollars to be paid to her at the
age of twenty one years, by my executor.
Item I give to my
grandson Joseph Anderson, the son of my daughter Hannah Anderson one negro
boy named Charles which negro my will is that my daughter Hannah Anderson
shall keep in profsefsion will said Joseph Anderson is twenty one years of
age and in case he should die without an heir my will is that my grand
daughter Peggy Anderson have said negro to be delivered to her at the age
of twenty one years of age.
My will is that my grand daughter
Peggy Anderson have one hundred dollars to be paid to her at twenty one
years of age.
My will is that in case sons Amasa Pitts or Asa
Pitts wither of them shall die without an heir that the legacy left to
them shall be equally divided between my youngest son Joseph Pitts and my
youngest daughter Celey Pitts.
Item My will is that all the
remainder of my estate that is not above named be sold and equally divided
amongst my children except my daughter Nancy Akin I cut off with the above
named sum of five shillings and I do hereby nominate and appoint my trusty
friend John S. Carwile and my wife Anna Pitts my true and lawful executor
and executrix of this my last will and testament and I do hereby utterly
disallow and revoke all and every former testament will or legacy
ratifying and confirming this and no other to be my last will and
testament.
In witnefs whereof I have hereunto set my hand and seal
this 23rd day of September one thousand eight hundred and
fifteen. Signed, sealed published pronounced and declared by the said
Joseph Pitts as his last will and testament in the presence of us who in
his presence and in the presence of each other have hereunto subscribed
our names, interlined before afsigned in these words (Charles and my will
is that my grand daughter Peggy Anderson have one hundred dollars to be
paid to her at twenty one years of age?)
