 Last Will and Testament of  Thomas Dalrymple

In the name of God, Amen, I Thomas Dalrymple, of State and District aforesaid

Newberry District being of sound and disposing mind and memory, but weak in body, and calling to mind the uncertainty of life, and being desirous to dispose of all such Worldly Estate as it hath pleased God to blefs me with, do make and ordain this my last Will, in the following manner, that is to say:

First I will and bequeath wife Nancy Dalrymple one Negro boy named Thomas and one Negro girl named Edy, two cows and calves, and one bed and furniture. I further will and bequeath to my said wife Nancy Dalrymple the sum of Fourteen hundred and sixty four dollars to be paid out of the monies arising from the sale of my Real estate, as her share of said Real Estate.

Again I devise and bequeath my Negro boy called Jim, and my Negro girl named Leanor and her increase, one horse, eight head of cattle, and thirty five head of hogs to my friend George Speak in fee simple in trust for the sole and separate use of Eleanor Dalrymple the wife of my son Stephen M. Dalrymple, and for the use of the children of my said son Stephen M. Dalrymple as well those that may be born after my death, as those born before.

It is further my will and desire that my friend George Speak take into his hand all dues or monies that shall or may be due together with interest from my Estate to my said son Stephen M. Dalrymple in fee simple in trust for the sole and separate use of Eleanor Dalrymple, the wife of said Stephen M. Dalrymple and for the use and education of the children of my said son Stephen M. Dalrymple.

It is further my will and desire that after the decease of my said son Stephen M. Dalrymple and his wife Eleanor Dalrymple that all the property above described, and all dues and monies for their and their childrens purposes be equally divided between all their children that shall survive after their death.

Again I will and bequeath to my grand son Thomas Butler one sorrel horse called paddy. It is further my will and desire that the whole of my estate both real and personal of what kind so ever that is not deposed of by will be sold immediately after my decease. Vis my Land containing five hundred acres and ninety more lefs upon a credit of one and two years, and my personal estate upon a credit of twelve months.

It is also my will and desire that out of monies arising from the sale of my Estate all my just debts and funeral expenses be paid. Again after the payment of all my Just debts and funeral expenses I give and bequeath to my Grand Daughter Sophronia Caroline Dalrymple the sum of three hundred dollars to be paid when she shall become of lawful age but if she shall die before marriage the money to Revert back again to my Estate.

Again it is my will and desire that after the payment of all my Just debts and funeral expenses, and after the payment of those specific Legacies, That the balance of the monies arising from the sale of my Estate be equally divided between my children, taking into consideration the charges which I hold against them for property received.

Viz, My daughter Elizabeth Butler, my daughter Susan Saterwhite, my friend George Speak for my son Stephen M. Dalrymple, the heirs of my son Wade Dalrymple Dec'd, my daughter Nancy Dalrymple, Thomas Dalrymple (son) and my daughter Sarah Ann Dalrymple.

It is also my will that if my daughter Sarah Ann die before she comes of lawful age or before she marrys, the money due her to revert back to my estate.

Again it is my will and desire that my friend George Speak allow in settlement for my said son Stephen Dalrymple, and his wife Eleanor Dalrymple and the children of my said son Stephen M. Dalrymple the sum of six hundred and eighteen dollars with interest.

In testimony where of I have here unto set my hand and affixed my seal, this 26th Feb. one thousand eight hundred and forty four.

Signed, Sealed, published and declared as an for the Last Will and Testament of the above named Thomas Dalrymple in the presence of us.
