In the name of God amen. I Thomas
Pitts of the State of South Carolina and District of Newberry being in a
reasonable good state of health of body and perfect sound mind and memory
thanks be to God for his mercy, and calling to mind the certainty of death
and the uncertainty of life, knowing that it is appointed for all persons
to die. I do make and ordain this my last will and testament. In the first
place I recommend my soul into the hands of almighty God who gave it me
and my body of flesh to the grave to be decently buried at the discretion
of my Executors hereafter named, and as touching such worldly estate an
God in mercy hath been pleased to blefs me with, I give and dispose of in
the manner following. (Vis)
- In the first place my will is that
as soon as my death as may be convenient, my Executors do expense to
public sale the whole of my Estate, both real, and personal (except on
negro girl named Caroline, and so much may be thought necessary for this
support of my wife Nancy Pitts for one year). My real estate on a credit
of one and two years, and my personal estate on a credit of twelve
months, and the monies arising there from together with that may be due
me, be applied to the payment of all my Just debts and funeral expenses.
- Secondly, I do give to my beloved
wife Nancy Pitts ninety five dollars.
- 3rdly I do give to my son Young John Herrington Pitts ninety five
dollars.
- 4th. I do give to my daughter Catherine Pitts eighty
three dollars.
- 5th. I do give to my daughter Mary Magdalene Tinsley,
eighty dollars.
- 6th. I do give my son Elijah Pitts, thirty dollars.
- 7th. I do give to my son Harrel Pitts, thirty dollars.
- 8th. I do give to my son David Pitts fifteen dollars.
- 9th. And I do give to my son Chaney Pitts, five dollars.
Those sums of
money paid to cash of them as here directed make them all even with my son
Simon Pitts he having already received ninety five dollars, and the
fullness of said money (after paying as above) to be equally divided among
all my children namely David Pitts, Chaney Pitts, Mary Magdalene Tinsley,
Simeon Pitts, Elijah Pitts, Harrel Pitts, Catherine Pitts, and Young John
Harrington Pitts, and my wife Nancy Pitts, and my will is that my wifes
distributive share of my estate and the legacy before mentioned, be
attained by my executors in their hands and kept at interest for her use
and benefit, and paid to her annually in such portions as they may third a
reasonable support or as her necessities may require, and at her death or
marriage the balance remaining in the hands of my executors (if any) to be
equally divided amongst all my children above named and my will further is
that my daughter Catherine Pitts take my negro girl Caroline at her
appraised value in part of her distributive share of my estate which negro
girt together with her legacies and distributive shares that each of my
children may receive from my estates I do give to her and that end to her
and their heirs forever.
An I do constitute and appoint my son
David Pitts and my friend John K, Griffin my lawful executors to see to
the prosecuting this my last will and testament disannulling all other
wills and legacies by me before made, ratifying and confirming this and no
other to be my last will and testament. In witness whereof I have hereunto
set my hand and seal this 22nd day of January
1829.
