In the
name of God Amen. I William Pitts of the State of South Carolina and
District of Newberry being of sound and disposing mind and memory do make
and ordain this my last will and testament in manner following, to
wit.
I give and
bequeath unto my two grandsons, Giles C. Pitts and Joseph Pitts two
hundred and thirty acres of land more or lefs it being the same tract of
land laid off by me to their father Joseph Pitts, Deceased, and whereon he
lived in his lifetime and at the time of his death, which said tract of
land the said Gilen C. Pitts and Joseph Pitts now has in possession-
I have given to my son John Pitts his full share of my real
estate.
I have given to my son Nathan Pitts his full share of my
real estate.
I give and bequeath to my daughter Rebecca Goggans
the wife of Baley Goggans, one hundred acres of land more or lefs lying on
the north side of Hays Branch which branch is the dividing line between
her land now willed and the land whereon I now live and is bounded on the
other side of Sandy run.
I have given to my daughter Elizabeth
Davis her full share of my real estate.
I give and bequeath unto
my grandson Silas Goggans seventy five acres of land more or lefs
beginning at a corner to be made on a spring branch known by the name of
Giles Spring Branch the said corner to be made on the original line
adjoining the land by me willed to Giles C. Pitts and Joseph Pitts,
running down the said branch until it intersects Sandy run, thence up
Sandy Run to a branch called Bays Branch to the original line thence along
the original line to the beginning corner.
I give and bequeath to
my grandson William Pitts, Jr. the son of my deceased son Asa Pitts, forty
five acres of land more or lefs lying on the south east of a spring branch
known by the name Giles Spring Branch adjoining lands of Amasa Pitts,
James Hall and lands that I have now willed to Giles C. Pitts and Joseph
Pitts, which said land is to come into his possession when he marries or
comes of age.
Also I give and bequeath unto grandson William
Pitts, Jr. sundry notes with interest that has or may accrue thereon a
schedule of which notes is contained in a receipt given me by John S.
Carwile for said notes as agent for the said William Pitts, Jr. said
receipt bearing date the 20th day of February 1830 the
principal of the said notes amounting to seven hundred and seventy three
dollars and 31 ½ cents, the time from which said notes severally bears
interest may be seen by reference to the schedule of said notes above
mentioned the above notes I give to the said William Pitts, Jr. in lieu of
a tract of land by me sold and conveyed to Asa Pitts which tract of land I
had intended to give to the said William Pitts, Jr. which he the said
William Pitts, Jr. is to receive when he marries or comes of age, and if
he the said William Pitts, Jr. should die before he comes of age and
leaves no legacy then came his three sisters, to wit. Eleanor Waldrop wife
of Hiram G. Waldrop, Nancy Peterson the wife of Hiram Peterson and Amy
Pitts is to receive the above legacy of lands and the money arising from
the aforesaid notes and interest to be equally divided among them and in
case wither of them should die without ifsue the survivor or survivors to
have said legacy, and in case they should all die before they come of age
and without afsue then and in that case the whole of said legacy to return
to my legal heirs.
My will further is that as soon as practiable after
my decease that the whole of my personal estate net herein before disposed
of be divided among the following legatees in the following manner:
to wit.
My two grandsons Giles C. Pitts and Joseph Pitts
to have one share between them, my son John Pitts one share, my son Nathan
Pitts one share, my daughter Rebecca Goggans the wife of Baley Goggans one
share.
My daughter Elizabeth Davis one share to her and the heirs
of her body, and my four grand children to wit., Eleanor Waldrop, the wife
of Hiram G. Waldrop, Nancy Peterson , the wife of Hiram Peterson, William
Pitts, Jr. and Amy Pitts the children of my son Asa Pitts deceased, one
share to be equally divided among them and in case either of them should
die before they come of age and without ifsue the survivor or survivors to
have the part coming to the one se dying, and it is my will and particular
wish that my executors herein named become the grandson of all the minor
legatees interested in my estate and I do hereby appoint them as ?
And I do hereby nominate and appoint my friend John S. Carwile and
my grandson Joseph Pitts my true and lawful executors of this my last will
and testament.
In witness whereof, I have hereunto set my hand and
seal this twenty ninth day of March in the year of our Lord One thousand
Eight Hundred and thirty four and in the fifty eighth year of American
Independence.

published pronounced and declared by the said William Pitts as his last
will and testament in the presence of us who in his presence and in the
presence of each other have hereunto subscribed our names as witness
thereto.
