Henry Sharp
Will of HENRY SHARP, deceased I, Henry Sharp of the county of Claiborne
and state of Tennessee, planter, do make and publish this my last will and
testament, hereby revoking and making void all former wills by me at any time
heretofore made. And first, I direct that my body be decently buried; and as to
such worldly estate as it hath pleased God to entrust me with, I dispose of the
same as follows.
First, I direct that all my debts and funeral expenses to be paid as soon after
my decease as possible out of any money that I may die possessed of or may first
come into the hands of my Executors from any portion of my estate, real or
personal.
Secondly, I give and bequeath to my wife Henneretter, during her natural life,
three servants, one man named Harry and his wife Mariah, and one woman named
Rachel; and the farm whereon I now live and bounded as follows, beginning down
the creek at the mouth of a branch on John Lay’s line, then up said branch so as
to include the field lying northeast of the mill, thence westwardly with the
north side of said field, and crossing the creek at the head of the mill pond,
and to the mouth of a lane, the line between the farm called the Butcher farm
and the farm whereon I now live, and then with said lane to the first cross
fence on the south side of said lane, then with said cross fence southwardly and
on the same direction so as to include the field southeast of the meeting house
and bound with said field to the creek, and down the creek as it meanders to the
beginning. And I also give and bequeath to my wife, one wagon and two horses and
three milch cows, eight killing hogs, and ten year old hogs, and three breeding
sows, and three beds complete, and my riding carriage, one two horse plough, two
shovel ploughs, and two bull tongue ploughs, two pair of gear, two hoes, two
sprouting hoes, and one axe, one mattox, two pots, two ovens, and two kettles,
two sets of plates, two sets of knives and forks, and two sets of teacups and
saucers, and one cupboard, one chest, and one bureau, and one clock, all of
which she is to have choice of all I possess. And in addition to the foregoing,
I give her my blacksmith tools, my iron toothed harrow, and my wheat fan, and
all the geese and poultry I have, and my broad axe, and all her own wearing
clothes, and all the moneys he has that is her own. And also that she has on
interest in her own name; also six dollars worth of leather, and ten head of
sheep, one scythe and cradle, and one mowing scythe. And I appoint my sons
William and Laban to set apart a sufficiency of all sorts of grain and
provisions for her to support on until she can raise again, all of which she is
to possess during her natural life. And at her death, I will that the above
named servant man Harry have his freedom, with the privilege of buying his wife
Mariah if he may wish to do so. And I will that Ham keep all the property that
he claims as his own, and also all the money he has, either in hand or on
interest by notes in my name. And all the balance of my estate I wish to be
disposed of as follows.
First, I give and bequeath to my son Peter, two servant children, one a boy and
one a girl, namely Joseph and Melicy, to be valued to him at or after my death.
They are Harry’s children.
Second, I give and bequeath to my son John, one servant man named Peter, at one
hundred dollars, and one servant man named Cato, and one servant boy named
Marquis D. Lafayette, Harry’s child, both to be valued to him at or after my
death.
Third, I give and bequeath to my son William, one servant man named Jesse, and
one servant boy named Henry, to be valued to him at or after my death.
Fourth, I give and bequeath to my daughter Eve, one negro boy named George, and
one servant girl named Matilda, Harry’s child, both to be valued to her at or
after my death.
Fifth, I give and bequeath to my son David, four servants, children, one girl
and three boys, the girl named Melissa Polly, child, the boys named Morris,
Ferdinand and Creed Fulton, Rachel’s children, to be valued to him after my
death.
Sixth, I give and bequeath to my son Laban, four servant children, two boys and
two girls named Julian, Frasier, Angeline Lafayette and Sarah Jane, all Harry’s
children, all to be valued to him at or after my death.
Seventh, I give and bequeath to my son Alexander, one servant woman named Sarah,
and two children, one Sarah’s child named Cain; the other Harry’s child named
Elbert Irvine, all to be valued to him after my death. I will that all the
servants above bequeathed, keep what is their own and take it with them to their
respective homes.
Eighth, I will that my daughter Mary and my daughter Elizabeth, and the lawful
heirs of my daughter Katharine (who is dead), all to have an equal part of my
estate, both real and personal, with all my lawful heirs, to be paid to them by
my Executors. And if this my will, give either of my heirs more when valued,
then an equal part with the others of my heirs, then they are to pay back to my
estate so as to give each an equal part of my estate. And I will that the large
boundary of land that I bought of Jacob peck, lying northwest of the Willow
Spring, and on the west side of the road called Cain’s Road, remain undivided
and unsold for the use of timber to all my children who remain in this country,
and all of them to have an equal right with each other, to use timber from any
part of said boundary of land, and that without compensation to the lawful heirs
of my estate, and no one of my heirs or Executors to sell or convey any part of
said boundary of land with the concurrence of all the others of my heirs who
remain in this country. However, I will that Peter Sharp have the land lying
north of where James Robertson now lives, to the top of the Chestnut Ridge, but
not to prevent any of this balance of my heirs from getting and using timber
from off of the same at any time. This last named portion of land to be bounded
on the east by Lost Creek, and on the west by a lading hollow in which there is
a cave and a spring, and the spring branch running into the cave. And whereas my
sons, Peter, John and William and myself have a sawmill on hand, and now in
building on Lost Creek near the head, I give and bequeath to my sons Peter, John
and William, all my right, title and claim on and to said saw mill and seat in
valuation.
And I give and bequeath to my son John, the tract that I bought of Barnabas
Butcher as designated in the deed I got of said Butcher, with a small skirt of
timbered land I bought of Pearson Barney on the south ridge on both sides of the
road leading from my house to Leach’s ford on Powell’s River; and also the grist
mill on the farm whereon I live, with the store and property that is a part and
parcel of said mill, for which lands and mill I value at three hundred dollars.
I also give and bequeath to my son John, the farm whereon I live, as bounded in
this will, at the death of my wife. I value to him at five hundred dollars,
which he is to pay when he gets possession of the said land and premises. And I
give and bequeath to my sons David and Laban, all the right, title and claim
that I have in a certain tract of land lying in Campbell County, Tennessee
state, on the north side of Powell’s River in said tract of land. My brother
Jacob Sharp and William Sharp have an equal part with myself on said tract of
land. There is a cave known by the name of the Big Cave, which I value to him at
sixty-six dollars.
I will that all my personal estate that is not disposed of by this will, be sold
at vandue on twelve months credit, to be divided between all my heirs so that
all and each of my bodily heirs have an equal part of my estate, both real and
personal, as valued by proper persons in accordance with this will.
Lastly, I do hereby ordain and appoint my sons William and Laban, Executors of
this my last will and testament. In witness whereof, I, Henry Sharp, the said
Testator, have to this my will, written on two sheets of paper sewed together,
this thirty-first day of July in the year of our Lord one thousand eight hundred

Codicil to the Will of HENRY SHARP, deceased Whereas, I, Henry Sharp, of
the state of Tennessee and county of Claiborne, have made my last will and
testament in writing, bearing date the 31st day of July 1848, and have thereby
disposed of my estate, both real and personal. Now, I do by this my will, to be
taken as a part thereof.
I will and direct that all my servants from the oldest to the youngest that have
not been disposed of, I give and bequeath to my sons Peter, John and William. I
gave my servant man Harry the privilege to buy his wife Mariah at the death of
my wife. I do hereby set price he is to give for her, which is two hundred
dollars. And in addition to what I have bequeathed to my son David, I give and
bequeath to him my servant girl Rachel at the death of my wife, to be valued to
him when he gets possession of her, And in addition to what I have bequeath to
my wife, two tables, six chairs, a cutting knife and box, one loom, and tire
iron to iron a wagon, a set of wagon wheels, and all the books she claims as her
own, and two water pails, one washing tub, and one churn, one pair of
steelyards, one barrel of salt, 25 lbs of wool rolls, and all the cotton I have
now growing, three dishes, two sets andirons.
Lastly, it is my desire that this my present codicil be annexed and be a part of
my last will and testament, to all intents and purposes. In witness whereof, I
